52 or assignes all such Patents Rights licences & Evidences whatsoever Concerning the premisses onelyjor only any part thereof be in his owne hands or in the hands of the said John Guyther his Brother & Lastly the said Nicholas Guither doth Covenant & grant to and w.th the said Richard Attwood his heirs & Assignes shall & may lawfully & Peaceably Possesse have & Enjoy all & singular the premisses w.th their appartenances without any manner of Lawfull Let disturbance or Eviction of the said Nicholas Guither or John Guither the Brother of the said Nicholas Guither & of their heirs or of either or any of them And alsoe that the premises Imediatly after the Ensealing and delivery of these presents shalbe surrendered and made over unto the said Richard Attwood without any Incumbrance or Incumbrances whatsoever had made or suffered Either by the said Nicholas Guither or the said John Guither the Brother of the said Nicholas Guither or any other person or persons from by or under them or either of them (The Rents & Services due to the Lord Prop.ry to the aforesaid Provinces of Maryland allways Excepted) from the which Rents & services hereafter to be due to the said Lord Prop.ry The said Richard Attwood doth Covenant & grant to and with the said Nicholas Guither shall and will att all times hereafter sufficiently save & keepe harmlesse the said Nicholas Guither & John Guither the Brother of the said Nicholas Guither & their heirs or any or either of them In wittnes whereof the parties aforenamed to these presents have Interchangeably sett their hands & seales the day and yeare above written Annoq Domi 1674 signed sealed and delivered in the presence Nicholas Guyther sealed of us John Hall W.m ╪ Stevens Michaell Rockford his m.rke on the back side of the aforegoing Deed was thus written viz.t Octob.r 8.th 1677 This Deed was then in Open Court by the said Nicholas Guither & Gwithliam his wife who was secretly Examined of her Consent to the same before the honn.ble the secretary in pursuance of the Act of Assembly in such case made) Acknowledged to be their Act & Deede to the ups in the same Deed specified John Blomfeild Cl Cur provin Know all men by these presents that I William Guither of S.t Maryes County am holden & firmly bounden unto Nicholas Guither of the same County the full and just quantity of two & twenty thousand pounds of good sound Merchantable Tobacco in Caske to be paid to the said Nicholas or to his certaine Attorney his Execut.rs Adm.rs or assigns to the which payment well and truely to be made I bind myselfe my heirs Execut.rs & Adm.rs formerly by these presents sealed w.th my seale & dated the one & twentieth Day of November 1674 The Condicon of this obligation is such that if the abovenamed Nicholas ^Guither^ & his assignes doe & shall from tyme to tyme and att all times hereafter peaceably & quietly have hold possesse and enjoy all that Parcell of Land comonly Called or knowne by the name of Eastmore lyeing & being in S.t Jeroms in the County aforesaid Contayning by Estimation four hundred Acres more or lesse & late in the tenure or occupation of Nicholas Guither deceased without any the Lett trouble suite denyall or molestation of the above bounden William Guither his hiers or assignes or any other person or persons whatsoever claiming by from or under him them or any or either of them without fraud or Covin that then this obligacon to be voyd or else to stand in full force sealed and delivered in the p.rsence of William Guyther sealed Char DeLarocke Thomas Keyting This Indenture made the sixteenth day of February Anno Domini one Thousand six hundred Seventy Seven Between George Smith late of S.t Maryes County Planter of the one part And Thomas Smith of the Same County Planter of the other part Wittnesseth that the said George Smith in Consideracon of four Thousand pounds of Tobacco to him in hand paid by the Said Thomas Smith the receipt whereof he doth hereby Acknowledg Hath granted bargained Sold Aliened Enfeoffed and Confirmed And by these presents doth grant bargaine Sell Aliene Enfeoffe and Confirme unto the Said Thomas Smith All that parcell of Land called Cambridge situate lyeing and being on the East Side of Chesepiake Bay neer Nantocoke River bounded as followeth Beginning att a marked Oake being a Corner Tree of a parcell of land surveyed for John Craycroft thence with a line drawn South South East upp Barren Creeke Ninty perches to a marked Gum thence with a line drawne East North East into the woods five hundred Thirty Three perches and one Third part of a perch to a marked Pine and from thence w.th a streight line drawn North North West Ninety perches to a marked Pine & from thence w.th a Right line drawn to the first |
