49 Interest of in or to the p.rmisses or any part thereof from by or under him the said Geo Wells In wittnes whereof the partyes first above named have to these p.rsent Indentures interchangeably sett their hands & seales the day & yeare first above written Sealed & delivered in the p.rsence of George Wells sealed James Frisby Nic Painter On the backside of the aforegoing Deed was thus written viz.t September 24.th 1677 The within written Deed of Indenture was then by the within named Geo Wells acknowledged before the Hon.ble W.m Calvert Esq.r & Thomas Taillor Esq.r Justices of the Provinciall Court to be his act & deed according to the uses in the same Deed specified Jn.o Blomfeild Cl Cur Provinciall This Indenture made this tenth day of July in the second yeare of the dominion of the right Hon.ble Charles Lord Prop.ry of the Provinces of Maryland & Avalon Lord Baron of Baltemore &c.a Annoq Dom One thousand six hundred seventy & seven Between Richard Fenwick of Calvert County in the said Province of Maryland planter on the one part And John Darnall of the said County & Province gentl on the other part Wittnesseth that the said Richard Fenwick for & in consideration of the full sume & just quantity of Twenty thousand pounds of good tobacco to him the said Richard in hand paid by the said John Darnall the payment whereof he the said Richard doth hereby acknowledge & thereof & of every part & parcell thereof doth hereby absolutely & cleerly exonerate acquitt & discharge the said John Darnall his heyres Ex.rs Admist.rs & assignes for ever by these p.rsents Hath given granted aliened bargained sold Enfeoffed & Confirmed & by these p.rsents doth fully cleerly & absolutely give grant bargaine aliene sell enfeoffe & confirme unto the said John Darnall his heyres Ex.rs Adm.rs & assignes for ever all that parcell of land now in the possession of the said Richard Fenwick on his assignes being part of Fenwick Manno.r lying scituate & being on the South West side of Petuxent River & runing by the said River as follows viz.t begining att a bounded tree in a Valley called Goose Valley by the side of Petuxent River & runing by the said River to a marsh & with the said marsh & swamp to a bounded Oak att the head of the said Swamp & from the said Oak runing South to another bounded Oak over the head of a Creek & from the said Oak to the outermost bounds of the said Manno.r & from thence to the said Creek & so bounded by the said Creek till itt intersect & come to the said Valley called Goose Valley being laid out for foure hundred acres more or lesse & being lately made over to the said Richard Fenwick by his late brother Cuthbert Fenwick as by the Records of the said County of Calvert more att large appeareth Together with all & singuler the rights members & jurisdictions priviledges & profitts writings manuscripts & evidence touching or concerning the same or any part thereof As also all houses orchards gardens outhouses tobacco houses fences woods underwoods now standing growing & being upon the same or any part thereof To have & to hold the said foure hundred acres of land with the Messuages tenements dwelling houses outhouses tobacco houses orchards & gardens & all & singular other the p.rmisses before menconed or intended to be hereby given granted aliened bargained & sold with their & every of their appurtennces & every of them & every part & parcell of them unto the said John Darnall his heyres & assignes forever And the said Richard Fenwick for himselfe his heyres Ex.rs & Adm.rs doth covenant promise & grant to & with the said John Darnall his heyres & assignes by these p.rsents that the said Richard Fenwick & his heyres all & singuler the aforemenconed to be hereby bargained p.rmissses with their & every of their appurtennces & every part & parcell of them unto the said John Darnall his heyres & assignes forever To & for his & (theire |
