363) 372 Manufacture of Europe as should be imported into any of them from any other place whatsoever by Land or by Water and if by Water of the Ship or Vessell in which they were imported with all her Gunns Tackle Furniture Amunition and Apparell one Third part to his said Maj.tie his Heires and Successours one Third part to the Governour of such Land Island Plantation Colloney Territory or place into which such goods were imported if the said Ship Vessell or goods be there seized or Informed against and sued for or otherwise that Third part alsoe to his said Maj.tie his Heires and Successors and the other Third part to him or them that should seize Inform or sue for the same in any his Maj.ties Courts in such the said Lands Islands Plantations Collonyes Terrytoryes or places where the offence was comitted or in any Court of Record in Ingland by Bill Information plaint or other Accon wherein noe Essoyne protection or Wager of Law should be allowed And further that where as in the same Statute made att the same Time and place aforesaid It was Enacted for the better prevention of Frauds that from and after the said Twenty fifth day of March 1664 Every person importing by Land any goods or Comodityes whatsoever into any the said Lands Islands Plantations Collonyes Terrytorys or places should deliver to the Governour of such Land Island Plantation collony Territory or place or to such person or officer as should be by him thereunto Authorized and appoynted within Four & Twenty houres after such Importation his and their names & Sirnames and a true inventory & perticuler of all such goods & Comodityes And noe Ship or Vessell coming to any such Land Island Plantation Collony Terrytory or place should Lade or unlade any goods or Comodityes whatsoever untill the Master or Comander of such Ship or Vessell should first have made knowne to the Governour of such Land Island Plantation Collony Territory or place or to such person or officer as should be by him thereunto authorized and appoynted the arrivall of the said Ship or Vessell with her name and the name and sirname of the Master and Comand.r and had shewne to him that she was an English Built Ship or made good by producing such certificate as aforesaid that She was a Ship or Vessell bona fide belonging to England Wales or the Town of Berwick upon Tweed and Navigated with out English Master and three fourths of the Marryners att the least English Men and had deliv.rd to such Governour or other person or officer a true and perfect Inventory or Invoice of Lading together with the place or places in which the said goods were Laden and taken into the said Ship or Vessell under the paine of the losse of the Ship or Vessell with all her Gunns Tackle Furniture and apparell and of all such goods of the growth production or manufacture of Europe as were not bona fide taken in and Loden in England Wales or the Town of Berwick upon Tweed to be recovered and divided in manner aforesaid As in the same statute is more fully conteyned Neverthelesse the said James Scott arriving in this place of Maryland upon the Twelfth day of August instant and coming to an Anchor in the port of Patuxent in the County of Calvert in the said Province of Maryland within the Jurisdiction of this Court and then and there riding att Anchor and we knowing the said statute to be of full force and unrepealed but the same Statute |
