371 (362 Maryland fs Att a Court of Admiralty held by Especiall Comission att the House of M.r Richard Keen in Calvert County the 29.th day of August in the Tenth Yeare of the Dominion of the Right Hon.ble Charles Lord Baron of Baltemore Annoqr Dm 1685 Present John Grigges Henry Brent Justices Thomas Sprigg Thomas Clegatt Nicholas Sewall Esq.r who as well for our Soveraign Lo.rd the King & the Lord Prop.ry Cheif Govern.r of Maryland prosecuteth Upon Information which followeth in these words ag.t James Scott Master of the Ship Albercorne of London Derry in Ireland Bee itt Remembred that on the nine and Twentyeth day of August in the yeare of our Lord 1685 Came here into Court the Hon.ble Nicholas Sewall Esq.r his Maj.ties Collector of all the Rates dutyes and Impositions due and payable to his said Maj.tie in Maryland by Robert Carvile his Attorney who aswell for our sov.rn Lord James the second by the Grace of God of England Scotland France and Ireland King Defender of the Faith &c And the Right Hon.ble the Lord Prop.ry Cheif Governour of this Province of Maryland as for himself in this behalf prosecuteth And aswell for the said Lord the King and the said Governour as for himself Exhibitted to the Court here his certain Bill of Information against James Scott Master and Comander of the Ship Albercorne of London Derry in the Kingdome of Ireland Thereby giving the Court here to understand and be informed That whereas in the Statute made in the Parliam.t of our late Soveraigne Lord Charles the second of England Scotland France & Ireland King Defendour of the Faith &c of Blessed Memory deceased In the Fifteenth yeare of his Raign att Westminster in the County of Middlesex in the Kingdome of England (amongst other things) it was Enacted by Authority of the same Parliam.t that form and after the Twenty fifth day of March A.o Dmi 1664 noe Comodityes of the Growth production or Manufacture of Europe should be imported into any Land Island Planta.n Collony or Territory or place to his Maj.tie belonging or which should there after belong or be ^in the possession of his Maj.tie his heires & successors^ in Asia Affrica or America (Tangier only Excepted) ^but what should be bona fide & w.thout fraud laden^ and Shipped in England Wales or the Town of Berwick upon Tweed and in English Built Shipping or which were bona fide bought before the first day of Octob.r 1662 and had such certificate thereof as was directed in our Act intituled an Act for preventing of Frauds and Regulating abuses in his Maj.tes Customes & Whereof the Master and three fourths of the Marryners at least were English and which should be carryed directly thence to the said Land Island Plant.a Collonyes Terrytoryes and places And from noe other places whatsoever Any Law Statute or usage to the contrary notwithstanding under the penalty of the losse of all such comodityes of the growth production or manufacture |
