36 Same more or lesse & now or late in the Tenure or Occupacon of the said Thomas Philips his Assigne or Assignes as to part by former Right or Rights & now the whole by vertue of A Certaine Patent of Record by & unto him the said Thomas his heires & Assignes thereof lately in Due forme obteyned & Granted (on the Said resurvey) Together with all & all manner houses outhouses buildings Orchards Gardens Trees Lands Tenements Rights Profitts benefitts members Hereditaments & Appurtenances whatsoever to the same Granted premisses & Every or any part thereof belonging or in any wise appertaineing (Royall Mines as in & by the said Patent Excepted) Together alsoe with the said Patent & all & Every other Patent & Patents Deeds Evidences & writeings whatsoever touching or Concerning the same Bargained premisses or any part or partes thereof To Have & to hold all & singular the said Lands houses Tenements & other the before herein Granted or Bargained premisses with all theire Every & either of theire Rights members Hereditaments & appurtenances whatsoever (Except before Excepted) unto him the said Edward Man his heyres & Assignes for Ever To & for the Only proper use & Behoofe of him the said Edward Man & of his heires & Assignes for Evermore To be Holden of the Cheife Lord or Lords of the Fee or Fees of the premisses by the Rents & services therefore to grow due & of Right accustomed to be paid And the said Thomas Philips for himselfe his heires Exec.rs & Adm.rs Doth Covenant Promise & Grant to & with the said Edward man his heires & Assignes by these p.rsents in manner and forme followeing That is to Say that he the said Thomas Philips his heires Exec.rs and Assignes All & Singular the said Lands tenements houses & premisses with the appurtenances hereby bargained & sold or mentioned or intended to be Bargained or sold unto him the Said Edward Man his heires & Assignes against him the said Thomas Philips his heires & Assignes & all & Every other person & persons whatsoever Shall & will Warrant Accquite & Defend for Ever by these p.rsents and that free & Cleare of & from all manner of Former & other Rights Interests properties Forfeitures Rents Arrearages of Rents Curthens Jointures Dowers the Joynture & Dower of her the said Mary & all other Claimes & Demands whatsoever The said Rents & Services which from time to time and att all times hereafter for and in Respect of the same premisses shall Grow due and payable to the Cheife Lord or Lords thereof in Respect of his or theire signioritye or signiorityes there alwayes Excepted and foreprized And Lastly that he the said Thomas Philips his heires & Assignes & all & Every other person & persons whatsoever lawfully haveing or Claiming or which shall or may hereafter lawfully have or Claime any Rightfull Estate or interest whatsoever att Law or in Equity of in or to the said Bargained premisses with the appurtenances & Every or any part parcell or member of the same from by under or in trust for him or them or otherwise howsoever shall & will from time to time & att all or any time or times hereafter for & Dureing the Space of Seaven yeares next Ensueing the Date hereof att the Request Costs & Charges in the Law of him the said Edward Man his heires or Assignes Make Doe Acknowledge Execute & suffer or Cause or procure to be made Done Acknowledged Executed & Suffered (together with the Legall Acknowledgement & Inrollment of these p.rsents All Every or any further or other Act Deed Grant Conveyance & Assureance Acts Deeds Grants Conveyances & Assurances in the Law whatsoever for the further better & more sure Granting settling & Conveying the said Lands Tenements houses & premisses with the appurtenances hereby Granted or mentioned or intended to be Granted & Every part & parcell thereof unto & upon him the said Edward Man his heires & Assignes for Ever According to the Purport tenno.r Effect true intent & meaning of these p.rsents As by him the said Edward Man his heires or Assignes or his or theire Councell Learned in the Lawes shall be reasonably Devised or Advised & Required In Witnesse whereof the said Partyes to these p.rsents Indentures have Interchangeably sett theire hands & Seales Thomas Phillipps sealed Mary Phillips sealed On the Back of y.e foregoing Deed was Endorsed (viz.t) Sealed & Deliv.rd by the within named Thomas Philips in the Presence of W.m Crosse Peter Sayer John Eason Sealed & Deliv.rd by the Within named Mary Philips in the Presence of Walter Dickenson Thomas Bagg John Man (This |
