359 (350 the said mann.r Lands Tenem.ts Messuages & p.rmises to and on the right heire of the said Justinian Gerard for ever Provided alwayes and it is fully and plainly ^covenanted^ concluded and agreed on by and between the said partyes to these p.rsents for them their heires and Assignes that it shall be lawfull to & for the said Justinian And that the said Justinian Gerard shall have full and Authority from time and att all times hereafter at will and pleasure by his deed or deeds in writing to demise grant and to farm Lett all or any the said Mann.r Messu.a Lands Tenem.ts & heredatam.ts and ev.ry or any part or parts thereof as well in possession as in reversion or in Possession or in Reversion unto any person or persons for one two or three Lives or for any number of yeares whatsoever by and under such Rents Reservations Coven.ts Conditions Limittations and agreem.ts as to him shall seem meet or without any Rent Reservation Covenant Condition or agreem.t as to him shall seem meet and at his will and pleasure And that when & as often as any such Demise Grant or Lease shall be soe made by the said Justinian Gerard of y.e p.rmises or any part or parts thereof the said partyes Trustee and each of them or the survivor of them and his and their heires and Assignes shall stand and be soe demised Leased or granted imediatly from and after every such demise Lease or grant made to the use and behoof of ev.ry such person or persons to whom any such Demise Lease or Grant shall be soe made & of their Exe.rs Admistra.rs and Assignes respectively only for and during the continuance of the Estate & Estates terme and Termes Intrest and Intrests to be limitted and exp.rssed in such Lease Demise or grant and under such Rents Reservations Condition & Condicons Limittation and Limitations as in or by such demises Leases or grants shall be limitted exp.rssed or conteined respectively according to the interest purport and true meaning of ev.ry such Demise Grant and Limitation and of the Reversion and Reversions Rents and services reserved and depending upon the same Demises Leases & grants And also after the end and expiration of ev.ry such demise Lease grant and Limitation to be made and as the same shall respectivly end and determine then from time to time of all and ev.ry such part & parts of the p.rmisses of the p.rmisses as shall be soe demised Leased or limitted as aforesaid to the use of such person and persons and in such mannor and form and of such Estate and Estates with such remaynder & remaynders as are before herin and herby limitted appointed and declared & to no other use intent or purpose whatsoever Provided likewise and it is further covenanted concluded condescended unto and agreed upon by and between the said partyes to these p.rsents that if the said Justinian Gerard doe and shall att any time or times hereafter in or by any writing under his seal and by him subscribed with his hand in p.rsents of three or more witnesses signify and declare that he is minded to alter Change revoke Determine frustrate or make voyd all or any the uses or Estates hereby made limitted or appoynted that then and from thenceforth all and ev.ry such use & uses Estate & Estates whereof or concerning which he shall soe signify & declare his said mind as aforesaid shall respectively be frustrated void revoked determined and of noe force or effert anything in these p.rsents conteined or any other matter or cause to the contrary hereof in any wise notwithstanding In Witnesse whereof the said Justinian Gerard and Sarah Gerard his wife partyes to these p.rsents have hereunto set and affixed their hands and seales the day and yeare before written Sealed and Delivered in p.rsence of us Jos Doyne Jus Gerard (sigil) Sarah Gerard (sigil) Gilb.t Clarke E Batson Memorand on the nine and Twentyeth day of July in the Tenth yeare of the Dominion of y.e Right Hon.ble Charles &c over this Province of Maryland Annoq Dm one thousand six hundred Eighty and five came before us Clement Hill and Richard Gardner Gentl two of his Lordships Justices of the peace for the County of S.t Maryes Justinian Gerard of the same Country Esq.r and Sarah his wife partyes to the [above and before] mentioned p.rmises and (the said Sarah being by me privatly and secretly examined according to act of Assembly of this province in such case made and provided and signified her full and free consent to the same) acknowledged the within |
