349) 358 uses Intents and purposes hereafter specified Hath Given granted enfeoffed & confirmed and by these p.rsents doe give grant enfeoffee & confirme unto the said John Llewellin and Robert Foster and their heires and Assignes for ever all that his Mannor of S.t Clements in the County of S.t Maryes aforesd lying between Wincococomico River and S.t Clements bay with all and singular the rights members & Apprtnces thereof and of and in all and singular the Messuages Tenem.ts houses buildings orchards Lands Meadows Leasows pastures Feedings Comons Woods Underwoods Reversions Rents services Wasts Estrayes Royaltyes Libertyes Priviledges Jurisdiccons Heridatem.ts and all other the Rights members and Apprtnces whatsoever to y.e sd Mannor belonging or in any wise appertaining or accepted reputed taken taken or known or occupied demised or Letten as part parcell or member thereof together also with all rents and yearly p.rffitts reserved due or payable by or upon any Demise Lease or grant Demises Leases or grants made thereof any part parcell or member thereof And all and singular other the messuages Lands Tenem.ts Reversions services and heridatam.ts whatsoever which he the said Justinian Gerard standeth seized off in any Estate of inheritance either within the Province of Maryland aforesd in the Collony of Virginia or in the Kingdome of England with the reversion and reversions remainder and remainders of all and singular the said premises And all the Estate Right Title Intrest Claym and demand whatsoever of him the said Justinian Gerard of in and to the same p.rmises and every or any part or parcell thereof also all such Deeds Charters Grants Writings Evedences papers and Emoluments as the sd Justinian Gerard now hath or ought to have for or concerning the same To have and to hold the said Lands Mannor Lands Tenem.ts and Messuages and all and singular other the p.rmisses before by these p.rsents granted or mentioned meant or intended to be granted (to witt) all the Right Title Intrest and Estate of him the said Justinian Gerard of in and thereunto with their and every of their apprtnces unto the said John Llewellin & Robert Foster their heires and Assignes for ever to the uses intents and purposes hereafter in these p.rsents limitted expressed and declared and to none other use intent or purpose whatsoever (that is to say) To the use and behoofe of him the sd Justinian Gerard and his assignes for and during the Term of the Naturall Life of him the sd Justinian Gerard without impeachm.t of or for any manner of Wast and after the Decease of the said Justinian Gerard then to the only use and behoof of the sd Sarah Gerard his wife for and during the Term of her Naturall Life for and in the name of her Joynture and in full recompence of her Dower and Title of Dower which she the sd Sarah shall or may have of or to the Lands Tenem.ts and Heridatam.ts of the said Justinian Gerard And after the decease of the said Justinian Gerard and Sarah Gerard then to the use and behoof of the heires of the Body of the said Justinian Gerard lawfully begotten or to be begotten And for default of such Issue to the use and behoof of the said John Llewellen and Robert Foster their heires and Assignes for ever upon this hope trust and Confidence nevertheless in them reposed by the sd Justinian Gerard y.t they the sd John Llewellin and Robert Foster and the survivor of them and his and their heires and Assignes And att all times after the ending of the said Estates of the said Justinian Gerard and Sarah his Wife of and in the said Mann.r Lands Tenem.ts Messu.s and p.rmises to them above limitted shall make such grants and Conveyances of y.e same and dispose distribute and imploy the Rents issues and p.rffitts thereof to such person and persons and in such mannerr and form at the sd Justinian Gerard or Sarah his said Wife (which of them shall survive and be the longer liver) by his or her last will and Testament in Writing (by him or her) to be subscribed with his or her own hand and sealed with his or her seal in the p.rsents of three or more witnesses or by any other writing to be by him or her subscribed and sealed in the p.rsents of soe many wittnesses as aforesd shall nominate declare or appoynt And for and in default of such denomination or appointm.t then that the persons trusted or the survivor of them his or their heires and Assignes shall convey and Assure the |
