351) 360 within written deed to be the act and deed of them the said Justinian Gerard and Sarah his wife to the uses intents and purposes therein mentioned and expressed In Testimony whereof we have hereunto sett our hands the day and yeare [aforesaid] 17 sides Clement Hill Richard Gardiner This Indenture made the five and Twentyeth day of November in the yeare of our Lord one thousand six hundred Eighty and five Between Francis Anketill of S.t Maryes County Planter sonn & heire of Francis Anketill late of Calvert County Gentl Deceased of the one part and the Hon.ble Nicholas Sewall Esq.r of Calvert County of the other part Witnesseth that whereas by Indenture dated Anno Domi 1654 Between William Eltonhead Gentl of the one part and the said Francis Anketill y.e Father of the other part The said William Eltonhead for some Consideration him thereunto moving did give grant Demise and to Farm Lett unto the said Francis Anketill & his Wife Jane Anketill and his brother ^John^ Anketill for the ^full^ term of their Three Lives That Neck of Land called Anketills and comonly known by that name and Joyning upon a Creeke called James Creeke and the further side of the Neck and with the Path going to the head of the said Creeke on the further side of the said Neck ^then^ in the possession of the sd Francis Anketill To have and to hold the said Tenem.t of Land so demised and his wife Jane and Brother John from the last day of the Nativity of our Saviour for y.e Lives of the aforementioned they yeilding and paying therefore yearly during y.e said Lives unto the said William Eltonhead his heires Exe.rs Admistra.rs or Assignes y.e rent of one Barrell of Sound Indian Corn with a clause of reentry for nonpaym.t of the said Rent And the said William Eltonhead did thereby Covenant and agree with y.e said Francis Anketill the Father that at the Death of any of the ^afore^said Lives for the heriot of a Cow Calf to put in another Lawfull heire of his own body and for successive to continue to him and his heires for ever with other Coven.ts therein conteyned as by the same Indenture under the hand and seal of the said William Eltonhead only w.thout any other Execution of Livery & seizin or Inrolem.t may more plainly appear And wheras the said parcell of Land and Tenem.t was and is parcell of the Mann.r of Little Eltonhead which said Mann.r with all itts rights members and apprtnces to the same belonging are by severall meane conveyances Loyally refred in the said Nicholas Sewall and the said Three Lives abovenamed being all Extinct and no new Life or Lives have ^been^ hitherto been put in or any heriot paid for the remaining the said Lives and by that means the Estate of the said Francis Anketill and his heires determined and the said Nicholas Sewall being with the rest of the said Mann.r in the possession and seizure of the said Land called Anketills and the said Francis Anketill party to these p.rsents clayming an Equitable intrest in the said by reason of his intrest att the time of his said Fathers Death and the said Nicholas Sewall for the ending of all controversies touching the same for the future being willing to purchase the Equitable Intrest of the said Francis party to these p.rsents and the said Francis having agreed to sell the same Now it is further Witnessed that the said Francis Anketill for and in Consideration of Two servants sold and delivered to y.e said Francis Anketill the son the Receipt whereof he doth hereby acknowledge from |
