299) 308 And by these presents doth fully Clearly & absolutely give grant bargain sell Alien Enfeoffe and confirme unto the said Joshwa Doyne his heires & assignes all that the aforesaid six hundred acres of Land butted and bounded laid out and surveyed by the survey aforesaid in the hands of the said Joshwa Stone being part & parcell of the aforesd tract of five thousand acres and all woods underwoods timber and timber trees standing growing or being upon the aforesaid six hundred acres or any part thereof and all waies Easm.ts Rights priveliedges and appurtenences whatsoever to the same belonging or of right appertaining and all the Estate Right proper Intrest clame and demand whatsoever which the said Elizabeth hath or doth clame of in & to the premisses or any part thereof To have & to hold the said six hundred Acres of Land and all other the premisses hereby bargained and sold or meant mentioned or Intended to be bargained & sold with the appurtinances unto the said Joshwa Doyne his heires and assignes to the onely propper use and behoofe of the said Joshwa Doyne his heires and assignes for Ever to be holden of his Cheif Lord or Lords of the fee or fees of the premisses under such rents and services as shall be therefore due and accustomed and the said Elizabeth Calvert for her selfe her heires Exec.rs & adm.rs doth covenant grant and agree to and with the said Joshwa Doyne his heires and assignes by these presents that she the said Elizabeth Calvert at the time of Ensealing hereof hath full pouer & Authority to grant bargain and sell the said six hundred acres of Land in manner and forme as aforesaid and that she hath not at any time heretofore made or granted any former or other grant bargain sale lease or assignment of the said six hundred acres of Land or any part thereof within the survey afores.d or otherwise Encumbred the same in title charge or Estate and that the same and Every part thereof now is and so from hence forth shall be remaine conteine & Endure unto the said Joshwa Doyne his heires & assignes for Ever free clear & free & clearly acquitted Exonerated and discharged off and from all & all manner of former and other bargaines sales guifts grants tittles debts charges & Encumberances whatsoever (the quitt rent hereafter to become due to the cheef Lord of the p.rmisses onely Excepted) and further the said Elizabeth for herselfe her heires & assigns by these presents that the said Elizabeth & her heires & Charles Calvert her sone shall and will at any time hereafter dureing the space of seaven yeares upon the request and at the Cost and Charges of the said Joshwa Doyne his heires or assigns make and grant unto the said Joshwa & his heires to the use of the said Joshwa and his heires such further and other assurance & assurances Conveyance & conveyances of the said six hundred acres of Land surveyed as aforesaid as by the said Joshwa Doyne his heires or assignes or his or their Councill Learned in the Law shall be reasonably devised or advised and required be it by fine feofment recovery release confirmation Enrolement of these presents or otherwise all which further assureances shall bee and Enure and shall be deemed adjudged construed and taken to be and Enure to the onely proper use and behoofe of the said Joshwa Doyne his heires & assignes and to and for non other use Intent nor purpose whatsoever In wittness whereof the parties aforesaid to these Indentures Interchangeably have putt their hands and seales the day & yeare first above written Elizabeth Calvert Sealed and delivred in the presence of Tho Grunwin memorand the 4.th day of Decemb.r 1684 Gilb.t Clarke Came before us Two of his Lops Justices of the provintial Court Elizabeth Calvert within named & acknowledged Blackewen the within written Indenture to be her act & deed for the sale of the six hundred acres within granted wittnes our hands the day & year aforesaid Vincent Lowe Henry Darnall |
