307 (298) To be held of the Lord Prop.ry of the said Province of Maryland for and under the rents and services by the originall Recited pattent reserved and hereafter to become due and paiable And the said Jonathan Squire for himselfe his heires Exec.rs adm.rs doth Covenant promise and Grant to and with the said Thomas Allison his heires & assignes that the said tract or Divident of Land with the appurtenances before by these presents bargained & sold or hereby Intended to be bargained and sold unto the said Thomas Allison his heires and assignes The said Jonathan for himself & his assignes shall and will for Ever warrant and defend the same off and from any other former Guifts Grants bargaines and sales whatsoever from by or under him or from by or under any other person or psons whatsoever In wittness whereof the said parties have hereunto sett there hands & seales the day & yeare aforesaid Jona.than Squire Sealed and delivred Nea Blakiston In the presence of W Taylard Acknowledged in open Court the third day of December 1684 Tho Gunwin Clk This Indenture made the fourth day of December in the Tenth yeare of the Dominion of the Ry.t Hono.bl Charles absolute Lord and prop.ry of the provinces of Maryland & Avalon Lord barron of Baltemore &c.a Annoq Dom 1684 Between Elizabeth Calvert of Calverts Rest in S.t Maries County in the said provinces widow on the one part and Joshua Doyne of the same County Gent on the other part Wittnesseth that whereas on or about the twelfth day of July 1654 there was laied out and surveyed for William Stone Esq.r Exec.r father of the said Elizabeth A Certaine Tract of Land Lyeing on the North side of potomack River and on the North side of a Creek of the said River called Nanjemy creek but then Avon River begining at the head of a branch of Avon now called poynton creek at a marked white oak standing near a fresh runne called poynton fresh bounding on the North with a line drawne East north east from the said oake for the Length of Nine hundred and five perches to a marked birtch tree standing by a fresh runne called stones fresh on the East with a line drawne south & by east from the said fresh for the length of Eight hundred perches unto Avon River on the south with the said River runing west southwest unto poynton Creek for the Length of Twelve hundred & Eighty perches on the west with the said creek conteyning & then laid out for five Thousand acres more or less as by Certificate Returned unto the Secretarys office of this province by Robert Clarke then surveyor and there Recorded (more at Large appeareth) And whereas Cæcilius of Noble memory Late Lord prop.ry of this province by his letter patent under the great seale of the said province bearing date the first day of Sept.r 1658 for the Consideration therein mentioned Did grant unto the said William Stone & his heires for Ever all that the aforesaid tract of Land or parcell as by the same patent upon Record in the secretaries office afores.d may alsoe more at Large appeare And whereas the said William Stone in and by his last will and Testament bearing date the third day of decemb.r 1659 Gave unto the said Elizabeth his daughter and her heires six hundred acres of his land of Nangemy lyeing in any place Excepting between his then dweling house and Cheshires as by the said Will Remaining upon Record in the office for probate of wills in this province Relation thereunto being had may alsoe more fully appeare which said six hundred acres of Nagemy Land is and was Intended by the said will as part of the foresaid Tract of Five thousand acres taken up and patented as aforesaid and whereas since the death of the said William Stone and in or about the yeare 1664 the said six hundred acres of Land was by the consent of all parties Intrested in the said tract (according to the true meaning of the said will) surveyed laid out bounded & Assertained which said survey now Remaines in the hands of John Stone of Charles County Gent for the use and benef.t of the said Elizabeth Calvert his heires and assignes (as she the said Elizabeth afirmeth) as by the same survey Relation thereunto likewise had will more fully appeare Now this Indenture further wittnesseth that for and in consideration of the sume of Five & Twenty thousand pounds of tobaco to the said Elizabeth Calvert in hand paied at and before the Ensealing thereof by the said Joshua Doyne the receipt whereof the said Elizabeth Calvert doth hereby acknowledge and herselfe thereof & therewith fully satisfied and thereof and of Every part thereof doth clearly acquit and discharge the said Joshua Doyne his heires Exec.rs and administrators and Every of them by these presents she the said Elizabeth Calvert hath given Granted bargained sold Aliend Enfeoft and Confirmed And |
