289 (279 p.rsents In Wittnesse whereof I have hereunto sett my hand & seale the day of July in the seaventh yeer of the Dominion of the Right Hono.ble Charles &c over this province Annoq Dom 1682 Sealed & Delivered in the p.rsence of Elias King W.m Carpender (sealed) W.m Carpender Underneath the foregoing Letter of Attorny was thus written Proved in Court by the Oath of Elias King June y.e 27.th 1683 This Indenture made this fifteenth day of February in the Eight yeere of the Dominion of the Right Hono.ble Charles Absolute Lord & prop.ry of the Province of Maryland Lord Baron of Baltemore & in the Yeer of Our Lord God One thousand six hundred & eighty two betweene William Smyth of Calvert County in the province of Maryland of the One partie & Henry Mitchell of the same County in the province aforesaid on the other partie Wittnesseth that the said W.m Smyth For & in Consideration of the sume of twenty pounds sterling money to him in hand paid by the said Henry Mitchell before the ensealing & delivery hereof whereof & wherewith the said W.m Smyth doth acknowledge himself to be fully & wholly satisfyed & doth of & for every part & parcell thereof acquitt & discharge y.e said Henry Mitchell his heires Executo.rs Adm.rs & Assignes by these presents hath given granted bargained sold Alliened enfeoffed & Confirmed & by these presents doth fully Cleerly & Absolutely give grant bargaine & sell enfeoffe & Confirme to the said Henry Mitchell his heires & Assignes all that parcell of Land Called Gunsbie being in Calvert County Lying upon the Clifts beginning att the west side Chesapiake bay at a marked pockikkory tree being a bounded tree of the Land of William Madewell & runing up the bay by a line drawne north & by west for Length one hundred perches to a bounded popular by the Land of John Newell To have and to hold the said parcell of Land with all & singular y.e Appurtenances thereunto belonging to the said Henry Mitchell his heires Executors & Assignes for ever to the only use & behoofe of the said Henry Mitchell his heires & Assignes for ever & the said William Smyth for himself his heires Executo.rs & Administrat.rs doth hereby Covenant & grant to & with the said Henry Mitchell his heires & Assignes & every of them by these presents In manner & forme following that is to say that he the said William Smyth att the time of the ensealing & delivery hereof is fully seized of the premisses & hath good & Lawfull power & authority in his owne Right to grant Convey & Assure the said premisses ^&^ every part & parcel thereof unto the said Henry Mittchell his heires & Assignes in maner & forme aforesaid & also the said Henry Mitchell his heires & Assignes & every of them shall & may att all times dureing the Estate hereby made & passed quietly & peaceably have hold use & Inioy all & singular the said granted premises with the Appurtenances according to the true meaning hereof without any Lett trouble or Charge whatsoever of or by the said W.m Smyth his heires or Assignes or any of them ^lawfully^ haveing or Claiming to have any Right or title thereunto & the said W.m Smyth doth further Covenant & grant for himself his heires Executors Adm.rs to & with the said Henry Mitchell his heires & Assignes & every of them at the reasonable request Cost & Charges in the Law of the said Henry Mitchell his heires & Assignes to make acknowledge Execute & suffer & Cause to be made & acknowledged Executed & suffered all & every such farther & other Lawfull & rezonable act & acts assurance & Assurances in the Law whatsoever for the further & better assurance surety & sure makeing & Conveighing of the said Granted premisses with the appurtenances or any part thereof unto him the said Henry Mitchell his heires & Assignes According to the true meaning hereof or as by the said Henry Mitchell his heires & Assignes or his or their Councill Learned in the Law in that behalfe shall be reasonable devised |
