274) 284 Mortgages annueties rents arrearages of rent Statutes Recognizances Judgments extents executions debts Amerciaments Trusts orders degrees & of & from all other estates titles troubles Charges & Incumbrances whatsoever had made comitted suffered done or Executed by him the said Robert Masson or by him the said William Guyther or by any of his Ancestors or Relations or by their or any of their heires or Assignes or any of them (except one barrell of Indian Corne to be yeelding & paying yearly & every yeer unto the said William Guyther his heires Executo.rs or Adm.rs In such manner & forme & days as is in & by the aforesaid recited writing or deed of sale Limitted & appointed & also except the rents & services which henceforth shall grow due & payable unto the Cheife Lord or Lords of the fee or fees of the said premises for the said Robert Masson for himselfe his heires Executo.rs & Adm.rs & for every of them Doth Covenant promise & grant to & with the said John Baker his heires & Assignes by these presents That as well he the said Robert Masson & his heires & the said William Guyther & his heires & every of them as all & every other person & persons haveing & Lawfully Claiming or that herafter shall or may have or Lawfully Claime any Estate right title Interest or thing of into or out of the aforementioned to be hereby bargained premisses with the appurtenances or any of them or any part thereof by from or under him the said Robert Masson or by from or under the said William Guyther his Ancestors or relations shall & will from time to time & att all tymes hereafter upon every reasonable request & at the Costs & Charges in the Law of the said John Baker his heires & assignes make do acknowledge Levye suffer & execute all & every such further & other Lawfull & reasonable act & acts thing & things device & devices assurance & assurances in the Law whatsoever for the further better & more perfect assurance sure makeing & Conveying of all & singular the before mentioned to be hereby bargained premisses with their & every of their Appurtenances & every part & parcell thereof unto the said John Baker his heires & Assignes to & for his & their own proper use & behoofe for ever as aforesaid according to the true meaning of these presents Bee itt by deed or deeds Inrolled or not Inrolled the acknowledging & Inrollment of these presents Fyne or fynes Recoverie or Recoveries Feoffment or Confirmation with warranty according to the true meaning of these presents or other wise without warranty by all any or so many of the waies or meanes aforesaid or by any other waies & meanes & in such maner & forme as by the said John Baker his heires or assignes or any of them or his or their or any of their Councill Learned in the Law shall be reasonably devised advised & required and Lastly it is hereby granted declared & Concluded & agreed by & between the said parties in these presents that all & every Fyne & Fynes recovery & recoveries Conveyances & other Assurances whatsoever hereafter had made acknowledged Levied suffered or executed or hereafter to be made Levied suffered or Executed of or concerning the aforementioned to be hereby bargained premises with their & every of their Appurtenances or any of them or any part or parcell thereof by or bettween the said parties to these presents or any of them or whereunto they or any of them are or shall be parties or privies and the full force effect & execution of the same & every of them shall be & enure & shall be had taken reputed deemed adiudged & Constued to be & enure to & for the only proper use & behoofe of the said John Baker his heires & Assignes for ever & to & for none other use Intent or purpose whatsoever In wittnesse whereof the parties first above named to these present Indentures their hands & seales Interchangably have sett & putt the day & year first above written Annoq Dom 1681 Signed sealed & delivered in the presence of us William Hatton George Parker Robert Masson (sealed) On the backside of the foregoeing deed was thus written March the 3.d 1681 Then Came Robert Mason & Susanna his wife & acknowledged the within deed of Conveyance to be by the said Robert Mason signed sealed & as his act & deed delivered to the uses within mentioned & the said Susanna being privately examined acknowledged that without the threats or fear of her said husband Robert Mason she doth frely & voluntarily Consent to the Conveying & assureing the promises within mentioned to the uses within specified & that the same is the proper estate of the said John Baker within mentioned Before us William Calvert Thomas Tailer |
