285 (275 This Indenture made the six & twentieth day of October in the Year of Our Lord one thousand six hundred eighty & two Between William Homes of S.t Maries County in the province of Maryland Planter & Frances his wife & Robert Carvile of S.t Maries County Gent of the one part & John Baker of S.t Maries County Inholder of the other part Wittnesseth that whereas William Lucas in his Lyfe time Late husband to Frances now wife to the said William Holmes had agreed to sell & convey unto Henry Ryder a parcell of Land Lying & being upon S.t Clares Creeke In S.t Jeromes in the said County Bounded upon the Creeke side North by a marked Oak & south by a marked pickhiccory being part of the Land whereon the said William Lucas then Lived & by him Laid out & bounded in his Life time But before a Conveyance of the said Land was executed He the said Lucas dyed haveing made his Last will & Testament in writing & the said Frances sole Executrix & by the said Will he did amongst other things impower his said Executrix to Confirme the sale of the said Land which he had sold to the said Ryder he paying the tobacco for the same as by the said Will bearing date the Thirteenth day of November Anno Dom 1675 may appear in pursueance of which said will the said Frances In Consideration of the sume of seaven thousand pounds of tobacco being the sume agreed between the said Lucas & the said Ryder to be paid for the purchaseing the said Land to her well & truly paid by the said Ryder did by her Indenture bearing date the fifth day of November Anno Dom 1677 Cleerly & absolutely give bargaine & sell & Confirme unto the said Ryder & his heires for ever the said parcells of Land with the Appurtenances thereunto belonging & the said Henry Rider did upon the same day by his writing under his hand & seale Indorsed on the same Indenture sell Assigne & sett over for the Like Consideration unto the said Robert Carvile the said Indenture to him the said Robert Carvile his heires & Assignes for ever but before the said Indenture & Assignment aforesaid were acknowledged to be Recorded according to Law He the said Henry Ryder departed this province and whereas the said William Holmes & Francis his wife for the better & more sure settling & estateing the said parcell of Land unto the said Robert Carvile & his heires for ever according to the said Assignment from the said Ryder & the deed made to the said Ryder from the said frances pursueant to the will of the said Lucas did by their Indenture bearing date the tenth day of July One thousand six hundred Eighty & one for the Consideration therein mentioned Bargaine sell release & Confirme unto the said Robert Carvile & his heires for ever the before mentioned parcell of Land and whereas the said Robert Carville for & in Consideration of the sume of eight Thousand pounds of good sound merchantable Leafe tobacco in Casque to be paid by the said William Holmes his heires Executors or Adm.rs to the said Robert Carvile his Executors Adm.rs or Assignes in maner following viz Two thousand pounds of tobacco upon the first day of January which should be in the yeer of Our Lord One thousand six hundred eighty & two & the like sume of two thousand pounds of tobacco upon the first day of January which should be in the yeer of Our Lord One thousand six hundred eighty & three & the Like sume of two thousand pounds of tobacco upon the first day of January which should be in the yeer of Our Lord One thousand six hundred eighty & four & the like sume of two thousand pounds of tobacco upon the first day of January one thousand six hundred eighty & five did give grant bargaine sell release & Confirme unto the said William Holmes & his heires for ever all that the before mentioned parcell of Land Lying & being upon S.t Clares Creek in S.t Jeromes bounding on the Creeke side north by a marked Oak & south by a marked pickhiccory being part of the said Lucas his Land whereon he dwelt & by him Laid out & bounded in his Life time with all proffitts & appurtenances whatsoever to the same belonging to have and to hold the said parcell of Land before by these presents mentioned to be granted bargained & sold to him the said William holmes his heires & assignes for ever free & Cleer & absolutely acquitted & discharged of all maner of former & other bargaines sales guifts grants Judgments titles troubles & Incumbrances whatsoever done by the said Robert Carvile or any Claiming by from or under him & the said Robert Carvile for himself his heires Executo.rs & Adm.rs did Covenant & agree to & with the said William holmes his heires Executo.rs & Adm.rs That he the said William Holmes his heires & assignes should & might from time to time & att all times hereafter peaceably & quietly hold & Inioy the said Land & premises without the lett suit or Interruption of him the said Robert Carvile or any other person or persons by Claiming by from |
