264) 274 bearing date the thirteenth day of September last past & remaining upon Record In the said Office) for four hundred Acres together with all waies passages woods Underwoods wood grounds & trees in & upon the premises & the ground & soile of the same woods underwoods wood grounds & trees to the said parcel of Land called (Toaes purchase) belonging & apperteyning (Royall Mines Excepted) & all other Rights benifitts & proffitts ariseing and arriveing or hereafter to arise & Arrive out of the said lands or any of the aforegranted premises together with letters patents belonging to the said Land to have & to hold the said land & all waies passages woods underwoods wood grounds & trees in & upon the premises & the ground & soile of the same woods underwoods wood grounds & trees & all other the aforegranted premises with their & every of their Appurtenances & every part & parcell thereof to him the said Daniell Toaes his heires & Assignes for ever Clear & free & Cleerly & freely discharged exhonerated & acquitted & other wise by the said Richard Peacock his heires Executors or Assignes rents Charge arrears of Rents the Rents & services hereafter to grow due to be paid & done only (accepted & foreprized) & the said Richard Peacock for him his heires Executors & Administrators doth Covenant promise & graunt to & with the said Daniell Toaes his heires & Assignes that he the said Richard Peacock the aforementioned parcell of Land Called Toaes purchase with all the aforegranted premises to him the said Daniell Toaes his heires & Assignes for ever warrant against him the said Richard Peacock & his heires & Assignes & every of them whatsoever In Wittness whereof I have hereunto sett my hand & seale the day & year first above written & in the Year of Our Lord One thousand six hundred Eighty & two accoumpted according to the Computation of the Church of England Signed Sealed & delivered in the presence of us John Rousby George Spencer Rich Peacocke Underneath the foregoeing Deed was thus written Aprill 27.th 1683 Then came before me Richard Peacock and Acknowledged the above Conveyance to be his Act & Deed as Wittness my hand the Day & Year above written C Baltemore Barbados A Know all men by these p.rsents that Sarah Leigh of the parish of Christ Church in the Island of Barbados widdow surviveing Administratrix w.th the Will annexed of Edward Oistine Late of the same parish and Island deceast Hath made Constituted & appointed And doth by these presents make Constitute & appoint The Hono.ble William Digges of Maryland Esq her true & lawfull Attourny to sue Arrest & Implead the Heires Executors or Administrators of Winlock Christison Late of Maryland aforesaid for the sale or deteyning of three Negroes by him receav'd In Barbadoes of M.r Edward Oisteine deceased in the year 1669 to be transported to Maryland aforesaid to be sold & disposed of by him for the best Advantage and accompt of the said Oistiene also to sue arrest & Implead all & every Other person & persons in whose Custody the said Negroes or any of them are till satisfaction be made together with all Damages ariseing therefrom Also to Compound & agree with any person or persons Concerned therein at the Discretion of him the said William Diggs Esq Hereby giveing & granting all her full power & Authority to Act & Doe in the premises as full & effectually to all Intents & purposes as if shee her were were from tyme to tyme personally present & to appear in all Courts & before all Lords & Justices as the case shall require both in law & Equity till satisfaction be had & made she Ratifying & Confirming whatsoever he shall Cause to be done therein And one Attourny or more to make & constitute & att his pleasure to revoke In Testimony whereof she hath hereunto sett her hand & seale the third day of December one thousand six hundred Eighty & two sealed & delivered in the presence of us Richard White Robert Boner Samuell Thurrmon Saragh Leigh |
