236 246 This Indenture made the fourth day of May in the seaventh yeare of the Dominion of the Right hono.ble Charles Absolute Lord and Proprietary of the Provinces of Maryland and Avalon Lord Baron of Baltemore &c And in the yeare of our Lord God One thousand Six hundred eighty and two Betweene William Guither of the County of S.t Maryes in the Province aforesaid gentl and Christina Barbera his wife of the one part and Thomas Griffin of the Same County planter of the other part Whereas William Hawley late of the Province aforesaid decd was in his life time Seized of an Estate in Fee Simple by vertue of the Letters Pattents thereof to him granted under the great Seale of this Province Of a Certaine tract of Land Lyeing on the west side of Chesepeake bay Containing Five thousand Seaven hundred Acres more or lesse For and upon the Conditions of Plantacon in the sd Letters Pattents menconed and expressed as in and by the said letters Pattents Remaining upon Record in the Office for Lands at the Citty of St Maryes doth & may more fully and at large appeare And the said William Hawley being Soe thereof fully Seized Did afterwards by his Last will and Testament in writeing under his hand and Seale Give and bequeath the Same unto William Guither aforesaid Sonn of Nicholas Guither decd and to his heires and Assignes for ever By vertue of wch Said Will and by a Decree in Chancery lately obtained hee the said William Guither is become Lawfully Seized and posessed of the same now this Indenture witnesseth that the said William Guither and Christina Barbera his wife For and in Consideration of the sume ot twenty thousand pounds of tobacco to him the said William in hand well & truely Contented satisfyed and payd Whereof and wherewith he acknowledgeth himselfe to be fully Contented Satisfyed and payd And thereof and of every part and parcell thereof Doth hereby Exonerate acquitt and discharge the said Thomas Griffin his heires Executo.rs and Adm.rs Hath Given granted bargained Sold Aliened Enfeoffed and Confirmed and by these p.rsents doth give grant bargaine Sell alien enfeoffe and Confirme unto the said Thomas Griffin all that Messuage or Tenement Called Griffins Choice parcell of S.t Clements Manno.r where the said Thomas Griffin Now Dwelleth in S.t Jeromes in S.t Maryes County aforesaid Begining att a marked Gum standing on the head of a Marsh that Lyes on the south side of Elias Beaches house and runing South from the said Gum unto the Land of William Cole unto a marked red Oake And from thence runing north west to a marked white oake And from thence runing south to another red oake And from thence south west unto the head of a Creeke called S.t Jeromes And from thence runing up the maine branch to the Outermost line of M.r William Guithers Land And on the north bounded upon a branch called the Beaverdam branch Of what quantity of Acres soever the same is contained Together with all houses out houses Barnes stables Edifices buildings gardens Orchards Fences Woods underwoods Timber trees and all and singular other y.e p.rmisses w.th the appurtenances thereunto belonging or in any wayes appertaining & all other pfitts benifits and Emoluments arriseing and accrueing or hereafter to arrise and accrue out of the aforementioned Lands and p.rmisses or any part or parcell thereof To have & to hold the said Lands houses outhouses Barnes stables Edifices buildings Gardens Orchards Fences Woods underwoods Timber trees & all and singular other the p.rmisses w.th th appurtenances to him the said Thomas Griffin his heires and Assignes forever Free & cleare and Clearly & Freely Exonerated and Discharged from all Singular or any former bargaines Sales Judgments (Rents |
