(232) 242 or under him her them or either of them or by his her or their act meanes Consent assent or procurement And futher that they the said Francis Leafe & Sarah his wife shall & will att the request & proper costs & charges in the law of the said Jenkin Smith his heires & Assignes w.thin the time & space of seaven yeares next ensueing the date hereof make doe acknowledge and suffer or cause to be made done acknowledged & suffered such further & other Conveyance & Conveyances assureance & assureances in the law of the said p.rmisses for the further better & more perfect assureing & conveying of the said p.rmisses unto the said Jenkin Smith his heires & Assignes whether it be by Fine or Fines recovery or recoverys w.th Double or Single voucher or Vouchers Feom.t of Feoffm.ts Deed or Deeds enrolled or not enrolled the enrolem.t of these p.rsent lease & release as by all & every of the said wayes or meanes as by the Councell learned in the law of the said Jenkin Smith his heires or Assignes shall be reasonably devised advized or required soe That the s.d Francis Leafe & Sarah his wife their heires Exec.rs or Adm.rs be not Compelled nor Compellable to travell further for the doeing of the same then the s.d Calvert County or the Citty of S.t Marys And lastly it is agreed by & between the said partyes to these p.rsents that all & every such further & other Conveyance and assureance of the said p.rmisses soe to be had made or done shalbe and enure and soe shalbe taken to be & enure to the only proper use and behoofe of the said Jenkin Smith his heires & assignes And to none other use inten or purpose whatsoever In witness whereof the said partyes to these p.rsents interchangeably have sett their hands & Seales the day and year first above written Francis Leaffe (sealed) Sealed and delivered in the the p.rsence of Tho Smith On the back side of the aforegoing Deed was thus written) mark of S L Sarah (Sealed) Richard Heath Memorand that the Tenth day of December One thousand six hundred Leafe John Carpenter Eighty & one Came before us Francis Leafe and Sarah Leafe the wife of the said Francis Leafe & did acknowledge the within menconed to be their Act & Deed Tho Tailer W.m Burges This Indenture made the Three and twentyeth day of August One thousand six hundred Eighty and One and in the Sixth year of the Dominion of Charles absolute Lord and Prop.ry of the Provinces of Maryland & Avalon Lord Baron of Baltemore Betweene James Ringgold of Kent County in the Province of Maryland Gent of the one part and the said Right honoble Charles Lord Baltemore of the other part Witnesseth that the said James Ringgold for the Consideracons herein after menconed Hath given granted enfeoffed & Confirmed and by these p.rsents doth fully freely and absolutely Give grant Enfeoffe and Confirme unto the said Charles Lord Baltemore his heires & Successo.rs for Ever All that building or structure lately erected by his Lopps Justices of Kent County aforesaid (together with the Consent & approbacon of the Inhabitants of Kent County aforesaid) being built onely for a Court house or house of Judicature for the said County and to or for noe other use Intent or purpose whatsoever Together with a Prison or Comon Goale neer adjoyning being alsoe lately erected And also all |
