241 (231 out for One hundred Acres of land more or less together with all rights profitts and benefitts thereunto belonging Royall Mines excepted To hold the same unto him the said Francis Leafe his heires and assignes for Ever to be holden of the said Lord Prop.ry & his heires as of the Manno.r of Baltemore in free and Comon Soccage by fealty only for all manner of services att & under the yearly rent of Four shillings of lawfull mony of England as in & by the said writed letters Patents relacon being thereunto had it doth and may more fully and att large appear Now this Indenture witnesseth that the said Francis Leafe & Sarah his wife aswell for and in Consideracon of the just sume and full quantity of Three thousand five hundred pounds of good Sound welcondiconed Tobacco in Casq.r to them or one of them in hand att or before the ensealing and delivery of these p.rsents by the said Jenkin Smith well & truely satisfied contented and paid the Receipt whereof they doe hereby acknowledge and themselves to be there with fully satisfied contented and payd And thereof and of every part and parcell thereof doe hereby acquitt exonerate and discharge the said Jenkin Smith his heires & Assignes As for diverse other good causes & consideracons them the said Francis Leafe & Sarah his wife thereunto especially moving Have granted bargained sold enfeoffed & confirmed and by these p.rsents Doe grant bargaine Sell enfeoffe & confirme unto the said Jenkin Smith his heires & Assignes aswell the said peece or parcell of land above writed together w.th all houses outhouses Ediffices buildings barnes stables Orchards Gardens Woods Underwoods Trees timber trees ways passages waters watercourses lights Easem.ts and appurtences to the same belonging or in any wise appertaining (Royall mines Excepted) As also all the Estate Right title & interest of them the said Francis Leafe and Sarah his wife their heires and Assignes of in and to the same And all letters Patents Charters Escripts writeings & Minuments of or belonging to the same either alone or together with other the lands of the said Francis Leafe & Sarah his wife or true Copyes of the same to be copied out att the Cost & charges of the said Jenkin Smith his heires or Assignes To have and to hold all the said peece or parcell of land and all other the p.rmisses with their and every of their appurtences unto the said Jenkin Smith his heires & Assignes for ever to his & their owne proper use and behoofe and to none other use intent or purpose whatsoever And the said Francis Leafe and Sarah his wife for themselves their heires Executo.rs and Adm.rs and every of them doe Covenant promise and grant to and with the said Jenkin Smith his heires & Assignes by these p.rsents In manner & forme following that is to say that they the said Francis Leafe and Sarah his wife now have in themselves good right full power and lawfull authority to grant bargaine sell enfeoffe & confirme unto the said Jenkin Smith his heires and Assignes the said peice or parcell of land & all other the above writed p.rmisses with their appurtences And that the same now is and soe shall bee & remaine unto the said Jenkin Smith his heires & Assignes a good & pfect Estate in free & Comon Soccage free & cleer and freely & clearly acquited exonerated and discharged of & from all former & other Guifts Grants bargaines sales leases for lives or yeares Judgem.ts Execucons Extents statutes Merchant or of the staple forfeitures Reentries Cause and causes of Reentries & Reentries Rents charge Rent seck arrearges of Rent Dowers title of Dower (the rent and services due to the Cheife Lord or Lords of the Fee or Fees onely excepted & foreprized) And of and from all other Cost Charges Expences damages Troubles & Incumbrances whatsoever had made Comitted suffered or done or to be had made comitted suffered or done by them the said Francis Leafe & Sarah his wife or either of them or by any other person or persons whatsoever haveing or clayming or or p.rtending to have & clayme any Estate right title or interest of in or to the same from by (or under |
