179 188 This Indenture made the six and twentyeth day of November in the yeer of o.r Lord One thousand six hundred and Eighty And in his fifth yeer of the Dominion of Charles absolute Lord and Prop.ry of the Provinces of Maryland and Avalon Lord Baron of Baltemore &c Betweene John Peirce of Calvert County in the said Province Gent sonn and heir of John Peirce of y.e said County and Province decd on the one part and William Digges of Notley hall in the County of S.t Maries in y.e s.d Province Esq.r on the other part Witnesseth That for & in Consideracon of the sume of Thirteen thousand pounds of Tobacco to y.e said John Peirce the sonne in hand paid att and before the ensealing & delivery of these p.rsents by the said William Diggs The receipt whereof he the said John Peirce doth hereby acknowledge accordingly and himself thereof & therew.th fully satisfied And thereof and of every part thereof doth clearly acquitt and discharge the said Will Digges his heires Executo.rs & Adm.rs and every of them for ever by these p.rsents He the s.d John Peirce the sonn hath grannted bargained sold aliened enfeoffed and Confirmed and by these p.rsents Doth fully clearly and absolutely Grannt bargaine sell alien enfeoffe & confirme unto the said W.m Digges and his heires All that parcell or Tract of Land called Peirces Encouragm.t lying in Baltemore County on the North side of Potapsco River upon the Western Branch begining att a bounded Red Oake and Runing Northwest nine hundred and Fifty six perches then southwest one hundred & sixty seaven perches then south East to a bounded Oake standing on a Point by the Lower falls of the said Westerne Branch then North East to the first bounded tree containing One thousand Acres by the same more or less And all & every the Rights priviledges benefitts and appurtences to the said p.rmisses of Right belonging or apperteyning And all pattents writings deeds and charters to the same belonging To have and to hold the said Tract or parcell of land and p.rmisses with the Appurtences unto the said W.m Digges his heires and Assignes To the only pper use and behoofe of the said W.m Digges his heires & Assignes for Ever To be holden of the Manno.r or Baltemore und.r the Rent and services therefore due and accustomed And the said John Peirce for him his heires Executo.rs and Administ.rs doth Covenant grannt and agree to and with the said William Diggs his heires and Assignes by these p.rsents That he the said John Peirce att the time of the ensealing and delivery hereof is & standeth rightfully and lawfully seized in the demeasne as of Fee of and in the said Tract or parcell of land and every part thereof And hath in himself full power & authority to grannt bargaine sell |
