189 180 Sell and Assure the same in manner and forme aforesaid And that the same and every part thereof shall from hence ^forth^ remaine continue and Endure onto the said Will Diggs his heires & Assignes free clear and clearly acquitted exonated and discharged of & from all & all manner of former & other bargaines sales gifts grannts titles troubles debts charges and Incumbrances whatsoever had made comitted done or suffered By the said John Peirce the father or the said John Peirce the sonne party to these p.rsents or either of them or any other pson or psons clayming or to claime by from or under them or either of them And also the said John Peirce & Sarah his Wife & their heires and all other pson or persons any estate haveing or lawfully clayming of in or to y.e p.rmisses or any part thereof by from or und.r the said John Peirce the Father and John Peirce the sonn or either of them shall & will att the reasonable request and att y.e costs and charges of the s.d W.m Digges his heires or Assignes such further & other Assurance & Assurances in y.e law for the further & more better Assuring the p.rmisses unto y.e s.d W.m Diggs his heires or Assignes make & grannt and that att any time when the same shall be required Bee if by fine Feoffem.t Release confirmacon acknowledgm.t of these p.rsents or other wayes howsoever As by him the said W.m Diggs his heires or Assignes or his or their Councell learned in the law shalbe reasonably devised advised or required provided the said Assurance or Assurances be made and done att y.e p per costs and charges of the s.d W.m Digges his heires or Assignes And that the pson or psons who shalbe required to make such assureance bee not compelled for the doing thereof to travell further then the City of S.t Marys And lastly That all such Assureance or Assureances shalbe & enure to the use and behoofe of the said W.m Digges his heires and Assigns for ever and to and for noe other use intent or purpose w.tsoever In witness whereof the partys aforesaid to these Indentures interchangeably have putt their hands and seals the day & yeer first above written John Peerce (sealed) Sealed & delivered in the p.rsence of Clement Hill Tho Grumein m.e This 10.th day of January 1680 Then came John Peirce & Sarah his Wife & the s.d John acknowledged y.e w.thin written Deed & y.e s.d Sarah was secretly examined according to y.e statute of Assembly & gave her free & voluntary consent to the sale of y.e land w.thin menconed w.thout any threats or fear of her s.d Husband In Testimony whereof I have hereunto sett my hand the day & yeer above written Henry Darnall |
