115 Pattented by Justinian Tennison and two hundred cents sould of it by the said Justinian Tennison to the said John Gwynn and John Brooke w.ch said parr part or one Moyety is out of the Two hundred acres afore Expressed Begining at a bounded Oake the Divideing tree Between John Gwyn and John Brooke Lyeing in the Woods on the west side of great Swampe Comeing from Piles fresh Runing thence the Divideing Line North and by West One hundred sixty foure perches to a bounded oake thence East and by North One hundred and foure perches to a bounded Oake thence south and by East One hundred forty foure perches to a bounded white Oake thence West south West to the first bound tree Contayning and now layd out for One hundred acres more or lesse Now in the tenure or occupacon or him the said John Gwyn or his assignes Together with all the houses Edifices buildings structures Orchards Gardens Fishings and fowleings and all and singular other appurtenances or privilidges to the said land belonging or in any manner of wayes appertayning To have and to hold the said land and premisses with theire and every of theire Rights Members and appurtenances and priviledges before by these presents bargained and sould or hereby intended to bee bargained and sould Together with all the privilidges aforemenconed to him the said Giles Willson his heires and assignes for ever And the said John Gwynn for himself his heires executo.rs and adm.rs doth Covenant promise and grant to and with the said Giles Wilson his heires and assignes that hee the said John Gwynn his heires Executors and adm.rs the said land and all other the afore bargained premisses and every part and parcell thereof w.th theire & every of theire Rights Members and appurtenances to him the said Giles Wilson his heires and assignes to the use above menconed against him the said John Gwyn his heirs Executo.rs and adm.rs and against all other person or persons shall and will warr.t and for ever hereafter defend by these p.rsents the Rents and Services w.ch hereafter shall become due to the Lord Proprietary for the same alwayes excepted and foreprized And that the said John Gwynn his heires Executo.rs and adm.rs shall at any time or times w.thin seaven yeares at the request and at the Cost and charges in the Law of the said Giles Wilson his heires and assignes Give make and deliver to the said Giles Wilson his heires and assignes any such further and better assureance or assureances as hee and they or his and theire Councell Learned in the Law shall him thereunto require In Witnesse whereof the parties first above Named to these p.rsent Indentures have Interchangeably sett to theire hands and seales the day and yeare first above written Signed sealed and delivered in the p.rsence of John Gwyn sealed John Dent Benjamin Towlson Aprill y.e 7.th 1679 Then received of Giles Wilson the summe of Two shillings sterling being for Alienacon of One hundred acres of Land called Mile End I say received the day and yeare abovesaid Gerrard Slye Sheriffe On the backside of the above written deed was thus written Viz Memorandum possession by Livery and seizen by Turfe and Twig was Delivered in p.rsence of John Dent & Benjamin Towlson Memorandum that on the 22.th day of February in the fourth yeare of his Lords.ps The L.d prop.ryes Dominion over this Province Annoq Domini 1678 Came before me John Gwyn the within menconed Vendor and did acknowledge the within Deed of bargaine and sale to bee his act and deed to Giles Wilson the within Mentioned Vendee And at the same time came before mee Sarah Gwynn the wife of hte said John Gwyn to acknowledge the aforesaid Deed who being privately examined did declare before mee that she doth this without any Compulsion Threats or Menaces of her husband or any other person whatsoever and that this Consent of hers was free and Voluntary of her spontanous will In witnesse Whereof I have hereunto sett my the Two and Twentyeth day of February In the fourth yeare of the Dominion of the Right Hono.ble Charles &c.a Over this Province Annoq Domini 1678 Thomas Notley |
