113 to them in hand paid by the said John Evans the receipt whereof they doe hereby acknowledge and thereof and of every part thereof doe clearly acquit Exonerate and discharge the said John Evans his heires Executors Adm.rs and every of them by these presents As also for divers other good Causes and Consideracons them thereunto especially moveing Have granted bargained sould Aliened Enfeoffed and Confirmed and by these p.rsents doe fully clearly and absolutely Grant bargaine sell alien Enfeoffe and Confirme unto the said John Evans all that the aforesaid parcell of Land with all rights proffitts benefitts and advantages w.th appurtenances thereunto belonging And all Writeings pattents Escripts and minuments w.ch doe any wayes touch or Concerne the same To have and to hold the said Tract of Land & p.rmisses with the appurtenances unto him the said John Evans his heires and assignes To his and theire owne proper use and behoofe for ever free and Cleare of all incumbrances whatsoever the rents and services hereafter to become due to the Lord of the Fee of the p.rmisses onely excepted And the said Thomas Smith and Alice his wife for themselves theire heires Executors and Adm.rs doe Covenant promise and grant to and w.th the said John Evans his heires Executors and adm.rs by these p.rsents that hee the said John Evans his heires and assignes shall and may for Ever hereafter peaceably & quietly have hold use occupy possesse and enjoy the aforesaid parcell of Land & p.rmisses w.thout the lett suite disturbance or eviccon of any person or persons whatsoever And that the said Thomas and Alice theire heires Executo.rs and Adm.rs the aforesaid Tract of Land and premisses with the appurtenances unto him the said John Evans his heires and assignes shall and will warrant and for ever defend against all psons whatsoever In witnesse whereof the parties first above named have hereunto Interchangeably sett theire hands and seales the day and yeare first above Written Sealed and delivered in p.rsence of Thomas Smith sealed Nic Painter Anthony Evans Alice Smith sealed On the backside of the aforegoing Deed was Thus Written Viz Wee acknowledge the within before us The Chancello.r and Secretary of this Province This eighth day of March 1678/9 Phillip Calvert William Calvert Maryland This Indenture made the tenth day of March in the fourth yeare of the Dominion of the Right Hono.ble Charles Lord Baron of Baltemore &c over Maryland Annoq Domi 1678 Between Thomas Smith of the County of Saint Maryes in the Province of Maryland and Alice his wife of the one part and Jacob Lockerman of the County aforesaid Chirurgeon of the other part witnesseth that the said Thomas and Alice for and in Consideracon of the Summe of Three thousand pounds of Tobacco to them in hand paid by the said Jacob The receipt whereof they the said Thomas and Alice doe hereby acknowledge an thereof and of every part and parcell thereof the said Jacob Lockerman his heires Executo.rs and adm.rs doe exonerate and discharge by these p.rsents have Granted aliened bargained sould Enfeoffed & Confirmed and by these presents for them theire heires Executo.rs and adm.rs doe fully Clearly and absolutely Grant alien bargaine sell enfeoffe and Confirme unto the said Jacob Lockerman his heires or assignes for ever all that Tract parcell of divident of Land Called Minshalls adventure lyeing on the East side of Chesiapeak bay in the County of Sommsett on a River called Pocomoke on the North side of the said River in a Creek called Divideing Creek on the Westermost side of the said Creek near the head of the said Creek Begining for Length at the Lowermost side of the Indian feild at a bridge that is Laid in the Creek neare the middle of a small ridge of high Land w.ch said high land Cometh Close to the Creek side and from the said bridge or middle of a small Ridge aforesaid Runing up into the woods south East five hundred thirty foure perches bounded on the West with a Line Drawne North West from the end of the former Line for breadth One hundred and Twenty perches Bounded on the North with a Line drawne North East |
