111 (102 Did acknowledge the Land in the Within written Indenture menconed to bee the right of them the within named Symon Spracklin and William Penn as those w.th the said Symon and William have of the Giuft of them the said Thomas and Elizabeth and for them and theire heires have remised and made quite Clayme thereof to the said Symon Spracklin and William Penn and theire heires for Ever And further they the said Thomas and Elizabeth have Granted for them and theire heires that the said Lands w.thin mentioned unto them the said Symon and William and theire heires against them the said Thomas & Elizabeth and theire heires they will warrant for ever and for this acknowledgement remise quite Claime and agreement the said Symon and William have given them the said Thomas and Elizabeth Fourteen thousand pounds of Tob Taken the day and yeare aforesaid Thomas Notley William Calvert This Indenture made the twelfth day of October in the third yeare of the Dominion of the Right Hono.ble Charles absolute Lord and proprietary of this Province of MaryLand and in the yeare of our Lord God One thousand six hundred seaventy right Between William Guyther of the County of S.t Maries in the province of Maryland Gent of the one part and Elias Beech of the County aforesaid plant.r of the other part Witnesseth That whereas William Hawley late of this province Esq.r Dec.d was in his life time seized of an Estate in Fee simple by vertue of Letters pattent thereof to him granted under the greate seale of this province of a Certain Tract of Land lyeing on the West side of Chesepeake Bay Contayning five Thousand Seaven hundred acres more or lesse for and upon the Condicons of Plantacon in And upon the said Letters pattent mentioned & expressed as by the said Letters Pattent remayning upon Record in the secretaryes office it doth more fully appeare and the said William Hawley being thereof fully Seized did afterwards by his last will and testament in writeing under his hand & Seale Give and bequeath the same unto William Gweyther Sonne of Nicholas Gweyther deceased and to his heires and assignes for ever by vertue of w.ch said will and by a Decree in Chancery lately obteyned hee the said William Gweyther is become Lawfully seized and possessed of the same Now this Indenture witnesseth That hee the said William Gweyther for and in Consideracon of the summe of Twelve Thousand pounds of Tobacco to him in hand paid by the said Elias Beech before the Ensealeing and delivery of these presents the receipt whereof hee doth hereby acknowledge and thereof and of every part and parcell thereof doth Clearly and absolutely acquitt and discharge the said Elias Beech his heires Executo.rs adm.rs and assignes by these p.rsents and for the rents and services hereafter due and reserved and for divers other good Causes and Consideracons him thereunto Moveing have bargained sold aliened Enfeoffed and Confirmed and doe by these p.rsents bargaine sell alien Enfeoffe and Confirme unto the said Elias Beech his heires Executo.rs adm.rs and assignes all that Tract parcell or dividend of Land Called Tom Longs Neck lyeing upon the south side of Saint Hellens Begining at a point Called Tom Longs point and runing up a branch of the Creeke to a Marked Gum standing about sixty yards above the dwelling house of the said Elias Beech then south to the bounds of William Colis land decd thence to Chesiapiake bay and from thence along the bay to Tom Longs point with all and every the lands Tenem.ts houses buildings orchards pastures Rights members and appurtenances to the said parcell of Land belonging or any waies apperteyning Together w.th all Deeds writeings Evidences grants Escrips or minuments whatsoever of or Concerning the same the said Elias Beech his heires or assignes paying therefore Yearely and every yeare unto the said William Gweyther his heirs Executo.rs Adm.rs or assignes at the now dwelling house on the plantacon w.ch hee the said William Gweyther Lives att the rent of two bushells of good sheld Indian Corne On the Feast of Saint Thomas the Appostle And if it shall happen the |
