MUNICIPAL CHARTERS

Tuesday, August 27, 1974, Saturday, August 31, 1974 and
Tuesday, September 10, 1974, and

WHEREAS, the Mayor and Council of The Town of New
Windsor desire to assure that the Charter Amendment set
forth in the Resolution passed on August 13, 1974 is
effectively and legally adopted, and to obviate any
question relating to proper publication with respect to
the Resolution; now therefore

Section 1. BE IT RESOLVED by the Mayor and Council
of The Town of New Windsor that the action taken at its
regular meeting held on August 13, 1974, in passing a
Charter Amendment Resolution be, and it is hereby,
ratified, and that said Resolution be, and it is hereby,
reenacted, the Charter of the Town of New Windsor being
amended by adding new Section 371A to the Code of Public
Local Laws of Carroll County (1965 Edition) to read as
follows:

371A.

(A)   THE TOWN MAY BORROW MONEY FOR ANY PUBLIC
PURPOSE, INCLUDING REFINANCING OF ANY INDEBTEDNESS OF THE
TOWN OUTSTANDING FROM TIME TO TIME, AND MAY EVIDENCE SUCH
BORROWING BY THE ISSUE AND SALE OF ITS GENERAL OBLIGATION
BONDS OR BOND ANTICIPATION NOTES. SUCH BONDS OR NOTES MAY
BE ISSUED AND SOLD IN THE MANNER PRESCRIBED IN SECTIONS
31 TO 37, INCLUSIVE, OF ARTICLE 23A OF THE ANNOTATED CODE
OF MARYLAND (1957 EDITION, AS AMENDED AND REPLACED),
TITLE "CORPORATIONS - MUNICIPAL", SUBTITLE "HOME RULE",
SUBHEADING "CREATION OF MUNICIPAL PUBLIC DEBT", PROVIDED
THAT, IF ANY ORDINANCE AUTHORIZING THE ISSUE AND SALE OF
ANY OF SUCH BONDS OR NOTES SHALL SO SPECIFY, THE BONDS OR
NOTES MAY BE SOLD AT PRIVATE SALE, WITHOUT ADVERTISEMENT
OR PUBLICATION OF NOTICE OF SALE, OR SOLICITATION OF
COMPETITIVE BIDS.

(B)    IN ORDER TO CARRY OUT THE MEANING AND INTENT
OF THIS SECTION, THE MAYOR AND COUNCIL ARE EMPOWERED TO
DO ALL THINGS AND TO TAKE ANY ACTION, BY ORDINANCE OR
OTHERWISE, DEEMED NECESSARY FOR THE REGULATION, EFFICIENT
OPERATION AND MAINTENANCE OF ANY WORK, PLANT OR SYSTEM,
OR ANY PART THEREOF, ANY PORTION OF THE COST OF WHICH MAY
BE FINANCED PURSUANT TO THE AUTHORITY OF THIS SECTION.

(C)    THE AUTHORITY AND POWERS CONTAINED IN THIS
SECTION SHALL BE SUPPLEMENTARY TO EXISTING LAW AND MAY BE
EXERCISED IN WHOLE OR IN PART BY THE TOWN NOTWITHSTANDING
ANY OTHER PROVISION OR LIMITATION OF LAW.

Section 2. BE IT FURTHER RESOLVED that the date of
the adoption of this Resolution is October 1, 1974, that
a complete and exact copy of this Resolution shall be
