CONFLICT WITH THE PROVISIONS OF THE ELEMENTARY AND
SECONDARY EDUCATION ACT OF 1965 OR ADMINISTRATIVE
REGULATIONS PROMULGATED UNDER THAT ACT.

(C) EACH APPLICATION OF A LOCAL SCHOOL SYSTEM FOR
STATE FUNDS WHICH MAY BE PROVIDED SHALL INCLUDE A
COMPREHENSIVE EDUCATION PLAN FOR GIFTED AND TALENTED
CHILDREN WHICH WILL EMPHASIZE DEVELOPMENT OF
QUALITATIVELY DIFFERENTIATED PROGRAMS FOR GIFTED AND
TALENTED STUDENTS. DIFFERENTIATED PROGRAMS INCLUDE: (1)
CURRICULA WHICH DENOTE HIGHER COGNITIVE CONCEPTS AND
PROCESSES; (2) PROVISIONS FOR SPECIAL GROUP ARRANGEMENTS
WHICH INCLUDE A VARIETY OF OPPORTUNITIES FOR SEMINARS,
INSTITUTES, WORKSHOPS, ENRICHMENT EXPERIENCES, TRAVEL
STUDY AND THE LIKE WHICH ARE QUALITATIVELY DIFFERENT FROM
THE GENERAL EDUCATION PROGRAM; (3) ALLOWANCE FOR FREEDOM
TO LEARN APART FROM THE USUAL CURRICULUM IN
INDIVIDUALIZED PURSUITS.

THE STATE SUPERINTENDENT OF SCHOOLS SHALL HAVE
OVERALL SUPERVISION AND CONTROL OF PROGRAMS FOR THE
GIFTED AND TALENTED PROVIDED THROUGHOUT THE STATE, AND
SHALL TAKE ACTION NECESSARY TO COORDINATE ALL THE
PROGRAMS. THE STATE SUPERINTENDENT, PURSUANT TO THE
PROVISIONS OF THIS CHAPTER, IS RESPONSIBLE FOR APPROVING
LOCAL PROGRAM APPLICATIONS AND FOR PROVIDING TECHNICAL
AND CONSULTATIVE ASSISTANCE TO SCHOOL SYSTEMS.]]

(A)    FOB THE PURPOSE OF THIS SUBTITLE THE GIFTED
AND TALENTED ARE THOSE ELEMENTARY AND SECONDARY STUDENTS
WHO ARE IDENTIFIED BY PROFESSIONALLY QUALIFIED PERSONS AS
HAVING OUTSTANDING ABILITIES IN THE AREAS OF GENERAL
INTELLECTUAL CAPABILITIES OR SPECIFIC ACADEMIC APTITUDES
OR IN THE CREATIVE, VISUAL OR PERFORMING ARTS.

(B)    THESE GIFTED AND TALENTED STUDENTS HAVE A NEED
FOR DIFFERENTIATED SERVICES BEYOND THOSE NORMALLY
PROVIDED BY THE REGULAR SCHOOL PROGRAM IN ORDER TO
DEVELOP THEIR POTENTIALITIES.

(A)    THE STATE BOARD OF EDUCATION SHALL ENCOURAGE
THE DEVELOPMENT AND IMPLEMENTATION OF PROGRAMS BY THE
COUNTY BOARDS OF EDUCATION AND BY THE BOARD OF SCHOOL
COMMISSIONERS OF BALTIMORE CITY FOR GIFTED AND TALENTED
CHILDREN.

(B)    TO THE EXTENT FUNDS ABE PROVIDED IN THE STATE
BUDGET OR ARE AVAILABLE FROM OTHER SOURCES, THE STATE
BOARD OF EDUCATION SHALL PROVIDE GUIDANCE AND
CONSULTATIVE AND TECHNICAL ASSISTANCE AND FISCAL SUPPORT
