[[(A) FOR THE PURPOSE OF THIS SUBTITLE THE GIFTED
AND TALENTED ARE THOSE ELEMENTARY AND SECONDARY STUDENTS
WHO HAVE BEEN IDENTIFIED BY PROFESSIONALLY QUALIFIED
PERSONS AS HAVING DEMONSTRATED A POTENTIAL FOP
OUTSTANDING ABILITIES. THESE STUDENTS HAVE A NEED FOP
DIFFERENTIATED EDUCATION OR SERVICES BEYOND THOSE
NORMALLY BEING PROVIDED BY THE REGULAR SCHOOL PROGRAM IN
ORDER TO ACTUALIZE THEIR POTENTIALITIES. EVIDENCE OF
GIFTED AND TALENTED CAPABILITIES MAY BE DETERMINED IN
MANY WAYS, INCLUDING BOTH OBJECTIVE AND SUBJECTIVE
MEASURES SUCH AS, BUT NOT LIMITED TO, INTELLIGENCE TESTS,
ACHIEVEMENT TESTS, TEACHER NOMINATION, PROFESSIONAL
ADJUDICATION, CREATIVITY TESTS, PEER NOMINATION, OR
OTHERS WHICH ARE RELATED TO THE FOLLOWING AREAS: (1)
GENERAL INTELLECTUAL ABILITY, (2) SPECIFIC ACADEMIC
APTITUDE, (3) CREATIVE OR PRODUCTIVE THINKING, (4)
LEADERSHIP ABILITY, (5) VISUAL AND PERFORMING ARTS, AND
(6) SUPERIOR PSYCHOMOTOR ABILITY.
106G.
(A) THE STATE BOARD OF EDUCATION, TO THE EXTENT
FUNDS ARE PROVIDED IN THE STATE BUDGET OR ARE AVAILABLE
FROM OTHER SOURCES, MAY ESTABLISH EDUCATION PROGRAMS FOR
GIFTED AND TALENTED STUDENTS OF THE FOLLOWING TYPES:
(1) NEW OR MODIFIED TEACHER TRAINING CURRICULA
TO INCORPORATE INSTRUCTION IN METHODS AND TECHNIQUES
DEVELOPED BY COMPETENT AUTHORITIES DESIGNED TO ENABLE
TEACHERS EFFECTIVELY TO IDENTIFY AND TEACH GIFTED AND
TALENTED CHILDREN;
(2) RESEARCH AND CONSULTATIVE PROJECTS
UNDERTAKEN TO ASSIST STATE AND LOCAL PUBLIC SCHOOL
AGENCIES IN CARRYING OUT THEIR RESPONSIBILITIES UNDER
THIS CHAPTER;
(3) EVALUATION, DEMONSTRATION, AND
DISSEMINATION OF FINDINGS RELATED TO PROGRAMS FOR GIFTED
AND TALENTED STUDENTS INDEPENDENTLY OR IN COOPERATION
WITH ANY PUBLIC OR PRIVATE AGENCY OR ORGANIZATION
ENGAGING IN RESEARCH AND DEVELOPMENT UNDERTAKINGS AIMED
AT GIFTED AND TALENTED CHILDREN.
(B) THE STATE BOARD OF EDUCATION SHALL ESTABLISH
CRITERIA TO GUIDE LOCAL SCHOOL SYSTEMS IN MAKING
APPLICATIONS FOR ANY STATE FUNDS WHICH MAY BE PROVIDED IN
THE STATE BUDGET SPECIFICALLY FOR THE PURPOSES OF THIS
SUBTITLE AND FOR FUNDS PROVIDED UNDER THE ELEMENTARY AND
SECONDARY EDUCATION ACT.
THESE CRITERIA APPLY TO THE EXTENT THAT THEY DO NOT
