adoption, amendment or [[recession]] rescission of
certain development regulations for areas of
critical State concern by local government, or by
the Board under certain circumstances; providing for
the Board and units of State government to assist
local government in preparing development
regulations for a designated area of critical State
concern; providing for certain judicial reviews;
providing for the authority of local government
concerning granting certain permits in a designated
area of critical State concern where the development
regulations are not yet effective and enabling the
local government by law to temporarily restrict or
suspend land use,, construction or develop within
such an area until the development regulations
become effective; requiring and establishing the
procedure for a person applying under applicable law
for State or local government authority to use,
develop or construct in a designated area of
critical State concern to notify the Board as to a
local government application, and the local
government as to a State application; authorizing
the Board to initiate, intervene in or become a
party with standing as a party in interest or an
aggrieved party or to file a certain environmental
or economic impact statement in any administrative,
judicial or other proceeding or participate in any
meeting in regard to any area situated in a
designated area of critical State concern [[, or in
regard to an area not so situated under certain
circumstances]]: providing for the manner of
initiation or intervention by the Board and certain
restrictions on such right of intervention;
requiring compliance with the provisions of this
Article; providing for certain assistance and advice
from the Attorney General and for him to represent
the Board; providing that the provisions of this
Article do not deprive a person of his
constitutional rights of his property without due
process and just compensation; renumbering sections
as appropriate; generally relating to the State
development plan and the designation of areas of
critical State concern in the State, and the
respective authority,, duties and functions of the
Secretary of State Planning, the Department of State
Planning, the State Land Use Board, and the Governor
in reference to such plan and such areas and to the
subject of land use management and planning; and
generally relating to and concerning State and local
government land use management and planning.
