of Special Funds," be and it is hereby repealed and re-enacted, with amendments,
to read as follows:
38B.
(a) Out of the highway user revenues, as defined in §38A(b) of this article,
which are allocated from the gasoline and motor vehicle revenue account of the
Transportation Trust Fund, as provided for in §11 (b) of Article 94A, to Baltimore
City to be used for the purposes set forth in §33 of this article, or to the several
counties and municipalities of the State to be used for the purposes set forth in §34
of this article, received by either Baltimore City, or the several counties and
municipalities of the State, there may be expended reasonable amounts for the
establishment and maintenance of footpaths, BRIDLE PATHS OR HORSE
TRAILS and bicycle trails whenever a highway, road or street is being
constructed, reconstructed or relocated and highway user revenues are being used
for such construction, reconstruction or relocation. Highway user revenues may
also be expended to establish and maintain footpaths, BRIDLE PATHS OR
HORSE TRAILS and bicycle trails along other highways, roads and streets and in
parks and recreational areas.
(b) In lieu of actually expending or obligating highway user revenue funds for
the purposes permitted by this section, the State Highway Administration, the City
of Baltimore, and the several counties and municipalities of the State may credit
such funds to a financial reserve or special fund to be held for not more than 10
years and to be expended only for the purposes required or permitted by this
section.
(c) Footpaths, BRIDLE PATHS OR HORSE TRAILS or bicycle trails shall
not be established under subsection (a) of this section, if:
(1) The establishment of the footpaths, BRIDLE PATHS OR HORSE
TRAILS and bicycle trails would be contrary to public safety;
(2) The cost of establishing the footpaths, BRIDLE PATHS OR HORSE
TRAILS and bicycle trails would be excessively disproportionate to the need or to
the probable use thereof; or
(3) The sparsity of population, the existence of other available ways or other
factors demonstrate an absence of any need for the footpaths, BRIDLE PATHS
OR HORSE TRAILS and bicycle trails.
(d) The State Highway Administration, when requested, shall provide technical
assistance and advice to Baltimore City and the several counties and municipalities
of the State in carrying out the purposes either required or permitted by this
section. The State Highway Administration shall recommend construction
standards for footpaths, BRIDLE PATHS OR HORSE TRAILS and bicycle trails
and shall prescribe a uniform system of signs for footpaths and bicycle trails which
shall apply to all the footpaths, BRIDLE PATHS OR HORSE TRAILS and
bicycle trails constructed pursuant to the requirements of subsection (a) of this
section, whether construction is undertaken by the State Highway Administration,
by Baltimore City or by the several counties and municipalities of the State.
(e) The use of footpaths and bicycle trails will be restricted to pedestrians and
nonmotorized vehicles, AND THE USE OF BRIDLE PATHS OR HORSE
TRAILS WILL BE RESTRICTED TO PEDESTRIANS, HORSES OR
HORSE DRAWN VEHICLES, unless the State Highway Administration,
Baltimore City, and the several counties and municipalities of this State
specifically approve other uses. Notwithstanding the provisions of this subsection,
the use of footpaths and bicycle trails shall be denied to sports cycles, trail bikes
