(f) As used in this section, "bicycle trails" means a publicly owned and
maintained lane, way or path designated, by appropriate signs, for use as a bicycle
route.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 216
(Senate Bill 219)

AN ACT to add new Sections 84 through 87, inclusive, to Article 88A of the
Annotated Code of Maryland (1969 Replacement Volume), title "Social
Services Administration," subtitle "Old Age Assistance," to follow immediately
after Section 83 thereof and to be under the new subheading "Community
Home Care Services," to create a program of community care services for
certain elderly persons and providing generally for the details and operation of
this program.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 84 through 87, inclusive, be and they are hereby
added to Article 88A of the Annotated Code of Maryland (1969 Replacement
Volume), title "Social Services Administration," subtitle "Old Age Assistance," to
follow immediately after Section 83 thereof, and to be under the new subheading
"Community Home Care Services," and to read as follows:

COMMUNITY HOME CARE SERVICES

84.

IT IS DECLARED THE POLICY OF THE STATE OF MARYLAND
THAT THE ELDERLY PERSONS OF THE STATE SHOULD HAVE
ACCESS TO A COMPREHENSIVE RANGE OF COMMUNITY SERVICES
TO ENABLE THEM TO REMAIN IN THEIR OWN HOMES AND OTHER
INDEPENDENT LIVING ARRANGEMENTS, CONSISTENT WITH THEIR
DESIRES, ABILITIES, AND SAFETY. TO IMPLEMENT THIS POLICY,
THE DEPARTMENT OF EMPLOYMENT AND SOCIAL SERVICES, WITH
THE ADVICE OF THE COMMISSION ON AGING AND THE
ASSISTANCE OF THE STATE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE, IS RESPONSIBLE FOR THE ADMINISTRATION
OF A SYSTEM OF COMMUNITY SERVICES FOR THE ELDERLY THAT
WILL SERVE AS AN EFFECTIVE ALTERNATIVE TO ANY
INAPPROPRIATE INSTITUTIONAL CARE FOR THE ELDERLY. IT IS
THE INTENT OF THE GENERAL ASSEMBLY THAT THE COMMUNITY
SERVICES UNDER THIS PROGRAM BE AVAILABLE TO ALL ELDERLY
PERSONS, BUT THAT THOSE ELDERLY PERSONS WHO ARE
FINANCIALLY ABLE TO DO SO SHALL PAY ALL OR A PORTION OF
THE COSTS THEREOF.
