702 Whereas the said Basil Wheeler is justly indebted to the said Lawrance Spencer one of his Creditors in the sum of Four hundred and fifty pounds Sterling as by his Account Current will appear and to several other persons his Creditors and hath proposed and agreed with William Sydebotham Attorney in Fact for Laurance Spencer Absolutely to resign convey and assure unto the said Lawrance Spencer and others his Creditors all that part of a Tract called Majors Choice begining at a marked Red Oak the beginning tree of the said Majors Choice and is the second bound tree of a Tract of Land called Franklin the Land of M.r Gamers being in the north and by west of William Hattons Land and runing with the said Line South and by East untill it meets a Gully and up with the said Gully to the head of it and thence with a Straight Line till it intersects a line of John Hawkens's Land thence with the said line towards the old Plantation till it meets a deep gully thence down the said gully untill it intersects the Line of Franklin thence with the said line to the beginning Tree containing P Estimation Seventy Acres more or less and all and every of his Share of Goods Wares & Merchandize in partnership with his Brothers John & George Wheeler together with all other Goods & Chattles of the said Basil Wheeler except as herein after excepted and Credits whatsoever of him the said Basil Wheeler be such Credits due in Partnership aforesaid or due by Judgment Bond Bill or otherwise wheresoever or from whomsoever to stand and remain in Trust for equal and proportionable use benifit and Advantage of all and every of his Creditors or such of them as Shall come and consent in Writing under their hands and seals to this agreement at or before the tenth day of Dec.r next ensuing the date hereof and in all things comply with the Terms and conditions expressed herein and for and towards the paying satisfying and dischargeing their severall debts due and owing or in proportion thereunto And the said Basil Wheeler dies further agree that the said William Sydebotham (Attorney) |
