649. of the said hereby released Premisses with the Appurtenances or any ^Part or parcell hereof in any^ wise heresoever To have and to hold the af.d part of the said Tract or Parcell of Land and all and singular the premisses herein before mentioned or intended to be hereby released with their Appurtenances unto the said Ephraim King his heirs and Assigns To the Intent and purpose that by virtue of the said Indenture of Bargain and Sale and of these Presents the said Ephraim King may be and become a good and perfect Tenant of the Freehold and Inheritance of all and Singular the said hereby released premisses with their Appurtenances that a Common recovery may be had perfected and Executed in such Manner as is hereafter mentioned And for that purchase it is hereby covenanted concluded and agreed by and between all the said parties to these presents that before the End of the next September provincial Court one or more Writ or Writs of Entry sur Disseisin en le post at the proper Costs and Charges of the same Mathew Kemp shall and may be brought commenced and prosecuted in the Name of the said John Murray as Plaintiff or Demandant against the said Ephraim King as Tenant Whereby the said John Murray shall demand against the said Ephraim King the said part of the said Tract or parcell of Land and all and singular the said hereby released premisses with their Appurtenances by such apt and convenient Names and Descriptions as shall be proper in that Behalf to Which said Writ or Writs the said Ephraim King shall appear Gratis in his own proper person or by his Attorney or Attornies lawfully authorised and Shall and will vouch or call to warrant the same Premisses the said Mathew Kemp who shall also appear gratis in his proper person or by his Attorney or Attornies lawfully Authorised and Shall and will enter into the said Warranty and vouch over to Warrant the same Premisses the Common Vouchee who shall thereupon appear and enter into the said warranty and after Imparlance make Default and such further and other Proceedings be had therein and all the said Parties shall so dem^e^an themselves that one or more good and perfect common Recovery or Recoveries with double Voucher Shall and may be had and suffered perfected and Executed of for and upon all and Singular the said hereby Released Premisses with their Appurtenances in all things according to the usual Course Order and Form of common Recoveries with Double Voucher for Assurance of Land in such Case ^used^ and Accustomed: And it is hereby covenanted further concluded declared and fully agreed by and between all the said parties to these presents for themselves and their Heirs and it is their true Intent and Meaning And the said common Recovery so as afs.d or in any wise other Manner to be had Suffered or Executed of for or upon the said hereby Released Premisses or any Part thereof and the full force Effect and Execution thereof and also all and every of otheir common Recovery and Recoveries and other Assurances had made suffered or executed or to be had made Suffered or executed of for or upon the premisses or any part thereof to which the said parties to these presents or any of them is are or shall be parties or party or privy shall be and enure and shall be construed expounded deemed and taken to be and enure to the only proper Use and Behoof of the said Ephraim King his Heirs and Assigns for ever & to and for no other Use Purpose or Intent Whatsoever In Testimony Whereof the (parties) |
