646 Ex.d This Indenture made the twentieth Day of September in the year of our Lord One thousand seven hundred and sixty five Between William Fields & Sarah his Wife of New Castle County on Delaware of the one part and George Gilpin of Kent County and province of Maryland of the other Part Whereas the said George Gilpin did at the provincial court held at Annapolis on the Second Tuesday of this present Month of September upon a Writ of Entry sur disseisin en le post before the Justices of the same Court recover by common Recovery against the said William Fields and Sarah his Wife all that Tract of plantable Land being part of a larger Tract called Myers's Chance beginning for the Tract so as af.d recovered at a bounded White Oak being the Beginning Tree of the said Tract called Myers's Chance and running thence North seventy one Degrees East Eighty seven perches thence South five Degrees and thirty Minutes West Ninety four perches thence with a Straight Line to the Beginning White Oak containing Twenty Acres being the same Land which was devised by the said Solomon Parsons to his said Daughter Sarah with the Appurtenances in Kent County af.d in with which Recovery the said William Fields & Sarah his Wife did vouch to Warranty the Common Vouchee Whereby a good and perfect common Recovery with Single Voucher of the said Premisses with the Appurtenances according to the usual Form of common Recoveries was had against the said William Fields & Sarah his Wife and their Heirs as by the Record thereof remaining in the said Provincial Court it doth more at Large appear Now This Indenture Witnesseth and it is hereby declared that the true Intent and Meaning of all the parties to the said Recovery and to these presents was before and at the Time of the said Recovery and yet is that the said Recovery and the Execution thereof should and shall be and enure and be construed judged and taken to be and enure that the said Recoveror and his Heirs should and shall tans and be seised of the said Premisses with the Appurtenances and of every Part and Parcell thereof to the uses Intents and purposes herein after set down expressed and declared and to no other use Intent or Purpose whatsoever that is to say to the use of the said George Gilpin and his Heirs for ever In Witness whereof the parties af.d have to these presents set their Hands and seals interchangeably the Day and year first above written Sealed & Delivered William Feilds seal In presence of her William Harwood Sarah S Feilds seal Jn.o Brice mark G Gilpin seal On the Back of the aforegoing Deed was thus written viz Be it remembered that on the twentieth Day of September in the year of our Lord one thousand seven hundred and sixty five personally appeared before me the Subscriber one of his Lordships Justices of the Provincial Court William Fields and Sarah his Wife and George Gilpin parties to the Within Indenture and did Acknowledge the same Indenture to be their Act and Deed to and for the Uses and purposes within mentioned and declared And the said Sarah being by me privately examined out of the Hearing of her HUsband did declare that she made her |
