644 before me the Subscriber one of his Lordships Justices of the Provincial Court James Hollyday and Philip Davis parties to the Within Indenture and acknowledged the same Indenture to be their Act and Deed to and for the uses & purposes within mentioned In Witness whereof I have hereunto set my Hand the Day and Year above written 4 sides Jn.o Brice Recorded 19.th September 1765 Ex.d This Indenture made this Eighteenth Day of September in the year of our Lord Seventeen hundred sixty five Between Elizabeth Earickson of the Isle of Kent in Queen Anns County Widow & Relict of John Earickson of the one part and Sowell Long of the same place Ship Carpenter of the other part Witnesseth that Whereas the af.d Elizabeth Earickson doth hold for the Term of her Natural Life or Widowhood one Messuage one orchard & one hundred Acres of Land being part of two Tracts of Land called Sarahs Portion & Johnsons Lott lying on the Isle of Kent aforesaid the immediate remainder or reversion Whereof did belong to a Certain John Errickson & the heirs Male of his Body who did Convey the same Lands to a Certain Joseph Gill who conveyed the same to the af.d Sowell Long Now the said Elizabeth Earickson for the perfecting some assurance Shortly to be made of the af.d Land and other the premisses by Way of Common Recovery and in Consideration of five Shillings Sterling in hand to her paid by the af.d Sowell hath granted & Surrendered & by these presents doth grant and Surrender unto the said Sowell Long & his heirs (upon Condition herein after mentioned) The afs.d parcells of Land & premisses and every part thereof & all the Estate right & Title of her the said Elizabeth therein To have and to hold the same Lands and premisses unto the said Sowell Long and his heirs upon Condition that if the said Sowell Long do in one Month from the Date hereof Execute & Deliver unto the said Elizabeth a Lease for the af.d parcells of Land for and during his Life or Widow Hood with the priviledges given to her the said Elizabeth by the will of John Earrickson Then & from thence forth his present Grant & Surrender shall be utterly void & of none Effect And then the said Elizabeth shall & may lawfully enter into & repossess the af.d Lands and premisses in her former Estate Any thing in these presents to the Contrary notwithstanding In Witness whereof the parties af.d have hereto interchangeably set their Hands & seals the Day and year first above written Sealed & Delivered Eliz.a Earickson Seal In presence of us Baruch Williams Phil R.d Fran.s Lee On the Back of the Aforegoing Deed was thus written viz Be it remembered that on the Eighteenth Day of September in the Year of our Lord Seventeen hundred sixty five Elizabeth Earickson within Mentioned (personally) |
