621) mentioned and the Lands and premisses therein mentioned and every part and parcell thereof to be the right and Estate of the said Humphry Wells his Heirs and Assigns for ever According to the true intent and meaning of the same Deed Geo Steuart 6 sides Recorded 11.th day of September 1765 Exam.d This Indenture Tripartite made this eighth Day of August in the Year of our Lord one thousand seven hundred and Sixty five Between George Shirley of Saint Marys County Planter of the first part Thomas Watt of the same County Planter of the second part and Mary Watt of the County af.d Widow of the third part Whereas for the docking baring and Extinguishing all Estate Tail and Reversions and Remainders thereupon expectant or depending of an in the Land and Premisses herein aftermentioned at the request Costs and Charges of the said Thomas Watt the said George Shirley ad Demandant is hereafter to prosecute and sue out of his Lordships High Court of Chancery his said Lordships Writ of Entry Sur Disseisin en le post against him the said Thomas Watt returnable and to be returned to the next provincial court at the City of Annapolis on the second Tuesday of September next whereby the said George Shirley is to demand against him the same Thomas Watt all that Tract or parcell of Plantable Land called Rhodes Rest scituate lying and being in Saint Marys County aforesaid being part of a larger Tract of Land called Fosberry devised in Tail to Mary Watt by Abraham Rhodes deceased containing one hundred Acres of Land with the Appurtenances thereunto belonging to which said writ the said Thomas Watt shall and will appear in his proper Person or by his Attorney or Attornies lawfully Authorised and impowered and vouch to warranty thereof the aforesaid Mary Watt who shall likewise appear gratis in her proper Person or by her Attorney or Attornies lawfully Authorized and shall and will enter into the Warranty thereof and vouch over to Warrant the same premisses the Common Vouchee who shall thereupon appear and enter into the said Warranty and after Imparlance make default and such further and other proceedings shall be therein so that one or more good and perfect Common Recovery or Recoveries with all ^double^ voucher shall and may be had suffered perfected and executed in all things according (to) |
