531 2.nd day of April 1765 then came before me the Subscriber one of his Lordships Justices of the Provincial Court Joseph Gill party to the within Deed and did acknowledge the same to be his Act and Deed and the Land and premises therein mentioned to be the Right Title and Estate of the within Named John Stewart and Duncan Campbell their heirs and Assigns for ever according to the true Intent and meaning thereof Geo Steuart Recorded the 2.d day of April 1785 7 1/2 Ex.d This Indenture made the Twentieth day of March Anno Domini Seventeen hundred and Sixty five between James Barnard of Frederick County in the Province of Maryland of the one part and Thomas Sprigg Wootten of the same County and Province of the other part Witnesseth that the said James Barnard for and in Consideration of the sum of Eighty five pounds Current Money to him the said James Barnard in hand paid by the said Thomas Sprigg Wootten the Receipt whereof he doth hereby acknowledge Hath Granted Surrendered remised released and for ever quit claim and by these Presents doth for himself his Heirs Executors and Administrators grant Surrender remise and for ever quit Claim unto the said Thomas Sprigg Wootten and to his Heirs and Assigns for ever part of a Tract of Land with the appurtenances lying in Frederick County aforesaid called Barnards Desire Beginning at the end of twenty four perches on the fifth Line of the said Land Called Barnards Desire and running thence East one hundred and fifty six perches North One hundred and forty perches North fifty Degrees west fifty six perches North twenty three Degrees West Seventy perches then by a Straight line to the beginning Containing One hundred and thirty Acres of Land more or Less with all his Right title Interest possession reversion property claim benefit and demand whatsoever of in and to the same To have and to hold the said One hundred and thirty Acres of Land with all and singular the premisses with the appurtenances thereunto belonging unto the said Thomas Sprigg Wootton his heirs or Assigns for ever And the said James Barnard doth Covenant promise grant and Agree to and with the said Thomas Sprigg Wootton his heirs Executors Administrators and Assigns and every of them by these presents that the said Thomas Sprigg Wootton his heirs and Assigns shall and may from time to time and at all times for ever hereafter Lawfully peaceably and Quietly have hold possess and Injoy all the one hundred and thirty Acres of Land hereby mentioned to be granted and released and receive the rents and profits thereof to his or their own use without any lawfull suit Trouble or Interuption whatever of or by him the said James Barnard his Heirs Executors Administrators or Assigns or of or by any other person or persons whatsoever lawfully Claiming or to Claim by from or under him the said James Barnard or by his means act default Neglect or procurement In witness whereof the said James Barnard hath hereunto set his Hand and Affixt his Seal the day and year first above written James Barnard seal signed sealed and Delivered in presents of David Lynn Samuel Beall Jun.r On the Back of the aforegoing Deed it is thus Written Viz.t March y.e Twentieth 1765 Received of Thomas Sprig Wootton Eighty five pounds Currant Money the Consideration within expressed James Bernard Testis David Lynn Sam.l Beall Jun.r March |
