518 Ex.d This Indenture made the twentieth day of December in the year of our Lord Seventeen hundred and sixty four Between Elizabeth Gaither and Joshua Warfeild of Ann Arundell County of the one part and Gerrald Hopkins of the said County Gentleman of the other part Wittnesseth that the said Elizabeth Gaither and Joshua Warfield for and in Consideration of the sum of Twenty four pounds sterling Money of Great Brittain to him in Hand paid by the said Gerrald Hopkins at or before the sealing and delivery of these Presents the Receipt whereof they do hereby acknowledge and the said Gerrald Hopkins thereof doth exonerate acquit and discharge Have and each of them Hath Granted bargained and sold aliened and Confirmed and by these presents Do and each of them Doth Grant bargain sell alien and Confirm unto him the said Gerrald Hopkins his Heirs and Assigns for ever all that part or parcell of Land lying on the Eastermost side of the North Branch of Patuxent River in Annarundell County called Luggox Begining at two bounded white Oaks they being bounded Trees of a Tract of Land called whites Hall and running thence North forty Eight Degrees West thirty four Perches and one half perch thence South West One hundred and Sixty five perches thence South two Degrees East fourteen perches to the given line of a Tract of Land called Angles thence with the said Given line to the begining Containing Twenty four Acres of Land more or less together with all advantages and appurtenances whatsoever to the said Land belonging or appertaining and also all the Estate Right Title Interest claim and demand whatsoever of them the said Elizabeth Gaither and Joshua Warfeild of in or to the said Tract or parcell of Land or any part thereof To have and to hold the said Tract or parcell of Land and premisses and every part thereof with the appurtenances to him the said Gerrard Hopkins his Heirs and Assigns for ever to his and their own proper use and behoofe and to no other use intent or purpose whatsoever and the said Elizabeth Gaither and Joshua Warfeild for themselves and each of them and each of their Heirs jointly and severally do Covenant promise Grant and agree to and with the said Gerard Hopkins his Heirs and Assigns by these Presents that they the said Elizabeth Gaither and Joshua Warfeild and each of them and each of their Heirs shall and will for ever hereafter Warrant and defend the aforesaid Tract of Land and premisses and every part and parcell thereof with the appurtenances unto him the said Gerrard Hopkins his Heirs and Assigns from and against them the said Elizabeth Gaither and Joshua Warfeild and each of them and their and each of their Heirs and from and against all and all Manner of Person or Persons whatsoever claiming or who hereafter shall or may Claim by from or under them the s.d Elizabeth Gaither and Joshua Warfeild or either of them or from by or under any other person or persons whatsoever and further the said Elizabeth Gaither and Joshua Warfeild ^doth Covenant and Agree to and with the said Garret Hopkins that they the said Elizabeth Gaither and Joshua Warfield^ their Heirs Executors or Administrators shall and will at any time when reasonably requested Doe and Execute any further Deed or Deeds of Conveyance for the better Assurance and Confirmation of all and singular the Bargained Premises to the said Gerrard Hopkins his Heirs and Assigns for ever which by his or their Council Learned in the Law shall be devised advised or required at the proper Costs and Charges of him the said Gerrard Hopkins his Heirs & Assigns In Wittness whereof the said Elizabeth Gaither and Joshua Warfield hath hereunto set their Hands and seals the day and Year above written Eliz Gaither E her mark seal Joshua Warfeild seal signed sealed and Delivered in the presence of us Jn.o Jiams Tho.s Watkins On |
