507 of Tracts of Land aforesaid with the Premises and Appurtenances to them and each and every of them belonging or in anywise Appertaining unto them the said James Dick and Thomas Richardson their Heirs or Assigns against all Manner of Persons Whatsoever will one ^well^ and Truly Warrant and forever defend by these Presents Provided always that ^in case^ the said Thomas Browning his Heirs Executors or Administrators shall well and truly Pay or cause to be Paid unto the said James Dick and Thomas Richardson their Heirs or Assigns the full and just & full sum of Three hundred and twenty five Pounds Sterling Money at or upon the twenty sixth day of August next ensuing together with legal Interest for the same to be Calculated and Paid from three Months after the date hereof then this Deed of Mortgage to be Void otherwise to be and remain in full Force and the said Thomas Browning for himself his Heirs Executors and Administrators further Covenants and Agrees to and with the said James Dick and Thomas Richardson their Heirs and Assigns that he the said Thomas Browning his Heirs Executors and Administrators the aforesaid sum of Three hundred and twenty five Pounds Sterling at or upon the twenty sixth day of August next ensuing with Legal Interest for the same after three Months from the date hereof as aforesaid unto them the said James Dick and Thomas Richardson their Heirs or Assigns will well and truly pay and Satisfy Accordingly In Witness whereof the said Thomas Browning hath hereunto set his Hand and Affixed his Seal the day and Year first within Written Signed Sealed and Delivered Tho.s Browning Seal in the Presence of Alex.r Symmer On the Back of the aforegoing Deed was thus Written James Dundass Viz.t Twenty sixth February 1765 Received of the within named James Dick and Thomas Richardson the sum of Three hundred and twenty five Pounds Sterling Money being the Consideration Money within mentioned Received P me £ 325 Ster Witness Tho.s Browning Alex.r Symmer James Dundass On the Twenty sixth day of February Seventeen hundred and Sixty five Personally Appeared Thomas Browning before me the Subscriber one of his Lordships Justices of the Provincial Court for the Province (of) |
