46. On this day the thirteenth of March One Thousand Seven hundred and Sixty Two Before me Robert Shank Notary & Tabellion Public dwelling in London by Royal Authority duly admitted and Sworn personally appeared M.r John Fish of this City Merchant who declared to have made Ordained Constituted and appointed as by these presents he doth make ordain Constitute and appoint his Dear and loving Wife Elizabeth Fish now ready to depart on a Voyage for Virginia Maryland and Quebec in North America his true and Lawfull Attorney Giving and by these presents Granting unto his said Attorney full Power & Lawfull Authority for him the Constituent in his Name and to his use to Ask demand Levy sue for and by all Lawfull ways and means recover and receive of and from Mungo Harvey now or late of Tappahannock River in Virginia Factor William Needham now or late of Rock Creek in Maryland also Factor George Frazer now or late of Potowmack River in Maryland Esquire and John Bondfield now or late of Quebec Merchant; Or of and from their any or either of their heirs Executors Administrators or Assigns or whom else it doth or may concern the several sums of Money from them respectively due Owing and Payable unto him the Constituent agreeable & conformable to their respective accounts hereunto Annexed and signed by him the Constituent for the several particulars therein mentioned and set forth Also the Constituent doth Authorize and Impower his said Attorney to Ask demand recover and receive all Intent already due and proffits accrued or which shall or may hereafter become due and accrue on Account thereof And to that End to account view settle and adjust all Accounts and the Ballance or Ballances thereof to receive upon recoveries and receipts to give and grant sufficient Releases Acquittances and Discharges in due Form of Law But in Case of Refusal or delay of Payment and satisfaction on the Parts and Behalf of the said Mungo Harvey William Needham George Fraser and John Bondfield or any or either of them their any or either of their Heirs Executors Administrators or Assigns or whom else it may Concern to make and render Just and true account Payment and satisfaction in any the Premisses afores.d him her or them so refusing or delaying thereunto to Compell by all Lawfull ways and means whatsoever And If Need be to Commence any Action or Actions Suit or Suits either in Law or Equity and the same to prosecute and Carry into Judgment and Execution Also to appeal before all Lords Judges and Justices in any Court or Courts whatsoever there to answer defend and reply to all Matters and Causes touching or |
