347. Ex.d This Indenture made this Sixteenth day of February in the Year of our Lord One Thousand seven hundred and Sixty four Between Samuel Beall Esquire late Sheriff of Frederick County of the one Part and Bazil Dorsey of the same County Gentleman of the other Part Whereas William Cumming Deceased on the fourteenth day of March in the Year of our Lord One thousand seven hundred and forty six by his certain Writing Obligatory Acknowledge himself to beheld and firmly bound unto the Commissioners or Trustees for omitting the Bills of Credit established by Act of Assembly in the sum of One hundred and forty eight Pounds lawfull Money of the Province of Maryland to be Paid unto the said Commissioners or Trustees to which Payment well and Truly to be made he bound himself his Heirs Executors and Administrators with Condition thereunto Written that if a Certain Robert Gordon his Heirs Executors or Administrators should well and Truly Pay or Cause to to be Paid unto the said Commissioners or Trustees or their successors at the Place where their Office should be kept for the Time being the Value of seventy four Pounds in Bills of Credit Current by the Law of the said Province or in Current Money of America on or before the Fourteenth day of February March then next ensuing with Lawfull Interest for the same at four PerCent PerAnnum that then the said Writing Obligatory should be Void and of no Effect Otherwise to be and remain in full Force and Virtue in law as by the said Writing Obligatory and Condition in the Provincial Court filed and Recorded referrence being thereto had may more fully Appear neither of which said sums of seventy four Pounds with Lawfull Interest for the same at four PerCent PerAnnum as aforesaid nor the aforesaid sum of One hundred and forty eight Pounds nor any Part thereof being Paid or Caused to be Paid (by) |
