23. appear And Whereas the said Philip being of said Water Mill Condemned Land and Premises with all and Every of their Appurtenances and Improvements so Estated & Possessed did on the Sixth day of June 1753 make and Publish his last Will and Testament in Writing wherein and whereby the subjected the same as part of his Personal Estate to the Direction & Disposition of his said last Will constituting therein his son Charles Hammond Party to these Presents as aforesaid Executor of the same as aforesaid and to whom the said Water Mill Condemned Land & Premisses aforesaid with the Appurtenances thereof hath as a Chattell real descended and accordingly for the Use and Benefit of the Devisees or Legatees under the Will of said Philip been appraised by Appraisers duly qualified and authorised to appraise said Personal Estate of said Testator and who hath Estimated and appraised the stream of Water Water Mill with its Gear & Utensils and the Twenty Acres of Land with the Appurtenances & Improvements thereon belonging unto the said Water Mill Collectively at the sum of Ninety Pounds Current Money which said sum the aforesaid John Hammond party to these presents above named Prostering in Purchase of said Water Mill Condemned Land & Premisses with the Appurtenances & Improvements thereunto belonging Now This Indenture Witnesseth that the said Charles Hammond Ex.r for and in Consideration of the Premisses and the Appraisement Value of said Mill &c (being the sum of Ninety Pounds Current Money as aforesaid) to him in hand at and upon the Ensealing & Delivery of these presents for and in Behalf of the Devisees under the will of said Philip as aforesaid well and truly paid and satisfyed by s.d John Hammond the receipt whereof he Doth hereby Acknowledge and thereof and from every Parcel thereof doth absolutely and freely acquit and discharge the said John his Heirs Ex.rs Adm.rs and Assigns & Every of them He the said Charles hath granted bargained and sold Released Assigned and set over and Doth by these presents grant bargain & sell release assign & sett over unto him the said John Hammond his Exrs Admrs and Assigns the Stream of Water and Water Mill afd with the Condemned Land afd whereof the same stands situate and bounded as aforesaid together with the Appurtenances and Improvements unto the same in any wise belonging with the Utensils & Yeer of said Mill and all and Singular the Issues & Profits & other Emoluments according or to accrue therefrom Also all the Right Title Interest Estate Property Possession Claim & Demand whatsoever which he the said Charles as Executor of said Philip or Legatee or Devisee under his said last Will or otherwise hath or ought to have of in & to the said Water Mill Condemned Land & Premisses with the Appurtenances &c unto the same belonging and appraised therewith and deemed unto |
