214. Key had not Entry but after the Disseisin which Hugh Hunt thereof unjustly had made to the said John ^Ross^ within Thirty Years &c And thereupon at the same Court came the aforesaid Philip Key in his proper person and Defended his Right and did Vouch to Warranty the afd John Gardiner and Ignatius Wheeler who also appeared in their proper persons in the same Court and enterd into the Warranty thereof and afterwards did Vouch to Warranty thereof the Common Vouchee who also appeared in his Proper pson at the Same Court and did enter into the Warranty thereof and afterwards made Default whereby a good and perfect common Recovery of the Lands and premises aforesaid according to the Usual Course of Common Recoverys in such Cases used was had and Perfected as by the Record and proceedings thereof in the same Provincial Court among the Records of the same Court remaining fully appeareth Now this Indenture further Witnesseth and the afd John Ross John Gardiner and Ignatius Wheeler for themselves Severally and for their several Heirs Executors and Administrators do hereby Covenant grant and Agree to and with the said Philip Key his heirs and Assigns by these Presents and and do hereby signify and declare that the Recovery afd of the Lands and Premises afd so as afd had and suffered and the Execution thereof shall be and enure and at all Times forever hereafter shall be construed esteemed adjudged and taken to be and enure and by the parties to the said Recovery at the Time of suffering the same was intended and declared to be and enure to the only Proper Use and Behoof of the said Philip Key his heirs and Assigns and to no other Use Intent or Purpose whatsoever and the said John Gardiner and Ignatius Wheeler for themselves severally and for their several Heirs Executors and Administrators do hereby further Covenant Grant and Agree to and with the said Philip Key his Heirs and Assigns that they the said John Gardiner and Ignatius Wheeler and their several heirs shall and will at all Times hereafter when thereto required by the said Philip Key his heirs or Assigns appear in all Courts and do and suffer (at the proper Costs and Charges of the said Philip Key his heirs or Assigns) all and every such |
