196. one of the Sisters and Residuary Legatees of Samuel Gaither late of the City of Annapolis Innholder deceased of the one part and Ann Gaither Widow of the said Samuel Gaither of the other part Whereas the Said Samuel Gaither in his Life Time was Possessed of by Lease from Benjamin Tasker Esq.r for the Term of Ninety Nine Years renewable for Ninety Nine Years of a certain Lott of Land scituate lying and being on Charles Street in the City of Annapolis (described by a late survey made of the Said City N.o 27) subject to several Exceptions as by the said Lease bearing date on or about the Fifteenth day of October Seventeen hundred and Fifty Nine and Recorded amongst the Land Records of Ann Arundel County in Liber BB N.o 2 fo 312 & 313 Reference being thereunto had may more fully and at large appear And Whereas the Said Samuel Gaither decd on or about the Twentieth day of September Seventeen hundred and sixty two having first made his last Will and Testament in Writing and therein bequeathed to his sisters Cassandra who Intermarried with Thomas Linthicum and Mary who Intermarried with the aforesaid Edward Norwood all his Right to the aforesaid Lott of Land by Virtue of the Lease aforesaid for and during the Term afores.d (subject to the Exceptions afd) and appointed therein the said Mary and Benjamin Gaither his Brother Executor thereof who took out Letters Testamentary thereon as by the said Will recorded in the Prerogative Office of this Province reference being thereunto had may appear And Whereas the said Ann Gaither not having a Child by the Said Samuel Gaither deceased is According to Law Intituled to the one undivided Moiety of the aforesaid Lott of Land and Premises thereunto belonging during the Term aforesaid And the Said Thomas Linthicum and Edward Norwood by virtue of their Marriage afd and the Said Deceasd last Will and Testament are intituled to the other undivided Moiety of the said lott of Land & Premises thereunto belonging during the Term afores.d Now this Indenture Witnesseth that the Said Edward Norwood for and in Consideration of the sum of Twelve pounds Ten shillings Currency to him in hand Paid by the Said Ann Gaither the receipt whereof he doth hereby Acknowledge and himself to be therewith fully con |
