101. the said Edward Pontenay Shall appear gratis in his proper Person or by his Attorney or Attorneys lawfully Authorized and Shall vouch to Warrant the Premisses the Said Mayberry Helmes and Anne his Wife who shall likewise appear Gratis in their Proper Person it by their Attorney or Attorneys lawfully Authorized and shall and will enter into the Said Warranty and vouch over to Warrant the said Premisses the Common Vouchee who shall thereupon appear and enter into the Said Warranty and after Imparlance make default and such further and other proceedings shall be thereupon had so that one or more good and Perfect Common Recovery or Recoverys with Double Voucher shall and may be had suffered perfected and Executed in all things according to the Usual form of Common Recoverys with double Voucher for assurance of Lands in such Case used and accustomed And it is hereby further Covenanted Concluded granted declared and fully agreed by and between all the said Parties to these Presents That from and after the suffering and Perfecting the said Recovery or Recoverys [illegible] these Presents and the Assurance hereby made as also the Common Recovery or Recoverys so as aforesaid or in any other maner to be had suffered and perfected shall be and enure and shall be adjudged construed deemed and taken and is and was meant or intended and is hereby declared to be and enure to the Recoveror or the Recoverors in the said Recovery or Recoverys named or to be named and he and they and his and their Heirs shall stand and be seized of the Tract of land aforesaid and Premisses and every part thereof to and for the use intents and purposes following that is to say One hundred and Twenty four Acres Part thereof allready conveyed to the said Edward Pontenay to and for the use of the said Edward Pontenay during his natural Life and after his decease to and for the use of the heirs of her the said Anne And of all the remaining One hundred thirty three acres to and for the Use of him the said Mayberry Helmes and Anne his Wife during the Term of their natural Lives and after their decease then to be and Remain to and for the Use and behoof of such Person and Persons his and their Heirs and Assigns as she the said Ann shall by any Instrument in Writing purporting to be her last Will and Testament under her hand and Seal Executed in the Presence of three Witnesses limit and declare and aver for no other Use Intent or Purpose whatsoever In Witness whereof the parties to these presents have hereunto interchangeably put their hands and Affixed their Seals the day and Year first above Written Sealed and delivered in the presence of Mab Helm s J Hall s Elie Vallette Phil R.d Fran Lee Anne Helm s On |
