81) And by Virtue of the Power Given him by the Said Will of the Said Daniel Carroll Hath given granted Bargained and Sold and by these Presents Doth give grant Bargain and Sell unto the said Charles Carroll Junior and ^his^ heirs all the forementioned Moietys of Tracts of Land Viz.t One Moiety of the Tract of Land Called Ely O Carroll one Moiety of the Tract of Land Called Chance originally on the Second Day of September one thousand Seven hundred and nine granted to Charles Carroll Esq.r Deceased One Moiety of Cloven Couse To have and to Hold the Said Moietys of Ely O Carroll Chance and Cloven Couse to the Said Charles Carroll Jun.r his heirs and assigns for ever Containing the Number of Acres above mentioned be the Same more or less to the only Proper use and Behoof of the Said Charles Carroll Junior his heirs and Assigns forever and to ^no^ other use Intent or Purpose whatsoever and the Said Charles Carroll Esq.r doth hereby for himself his Heirs Executors Administrators and Assigns Covenant and agree to and with the said Charles Carroll Jun.r his Heirs and assigns to Warrant and for ever Defend the said Moietys of Ely O Carroll Chance and Cloven Couse unto the Said Charles Carroll Jun.r his Heirs and Assigns against all Persons whatsoever Claiming any Right or Title to the Said Lands from by or under him the Said Charles Carroll Esq.r In Witness whereof the Parties to these Presents have hereunto Interchangeably set their hands and affixed their Seals the Day and Year first above mentioned Signed Sealed and Delivered in the Presence of Cha Carroll seal Daniel Carroll Will.m Baker (On) |
