176) for themselves their and every of their Heirs by these Presents in manner following That is to Say That the Said Thomas Brouster Shall and will before the End of the Provincial Court held on the third Tuesday of May next perm^i^t and Suffer the Said James Johnson to Sue forth and Prosecute against him the Said Thomas Brouster one Writ of entry Sur Disseizen en le post Returnable before his Lordships Justices of the Provincial Court at Annapolis thereby Demanding against the Said Thomas Brouster the Lands and Premisses herein before mentioned by such name and names Number of Acres quantities ^Qualities^ Terms and Descriptions in the Said Writ to be Contained and in Such Manner and form as by Council learned in the Law Shall be Advised unto and upon which Said Writ of Entry So to be prosecuted and Sued forth the Said Thomas Brouster Shall appear Gratis and and Vouch to Warranty the Said George Maxwell & Elizabeth his Wife which Said George Maxwell and Elizabeth his Wife Shall appear in person and enter into warranty and after their Entring into warranty Shall Vouch to Warranty the Common Vouchee who shall Likewise appear and Imparl & Afterwards make Default and Depart in Contempt of the Court so that Judgment may be thereupon had and given for the Said James Johnson to recover the said Lands and Premisses against the said Thomas Brouster and for the Said Thomas (Brouster) |
