96) Atkinson and James Slemaker have since Proved the said Will and took upon themselves the Burthen and Execution thereof And Whereas the said James Slemaker is since the Province the said Will Deceased by means whereof the said George Atkinson is become the only Surviving Executor of the last Will and Testament afs.d And Whereas the said George Atkinson for the Satisfaction and Payment of a Part of the Money still remaining due on the afs.d Mortgage Consents and Agrees to Assign transferr and make Over to the said William Govane his Estate and Interest in the said Lands and Premisses under the afore recited Mortgage and the said Henry Morgan is Willing to Release his Equity of Redemption to the same Now this Indenture Witnesseth That the said George Atkinson for and in Consideration of the Sum of two hundred and fifty Pounds Sterling to him by the said William Govane in hand paid at or before the Sealing and Delivery of these Presents the Receit whereof he doth hereby acknowledge and thereof and therefrom and of and from every part and Parcel thereof doth hereby Release Acquit and Discharge the said William Govane his Heirs Executors and Administrators Hath Assigned Transferred and set over and by these Presents Doth Assign Transferr and set Over unto him the said William Govane his Heirs and Assigns all those several Tracts and Parcels of Land and Premisses in the said Recited Indenture mentioned called Friends Discovery lying and being in Baltimore County afs.d Containing by Estimation three Hundred and Ninety Acres one other Parcel of Land called Stones Delight Containing by Estimation One Hundred Acres and one other Parcell of Land called Locust Neck Containing by Estimation Fifty Acres with all and every the Appurtenances thereto belonging and all the Estate Right Title Interest use Trust property Claim or Demand whatsoever of him the said George Atkinson of in or to or out of the said hereby Aliened or Assigned Lands and Premisses or any part thereof and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and of every part and Parcel thereof To have and to Hold the said Several Tracts of Land and all and Singular other the Premisses herein before mentioned or intended to be hereby Assigned Transferred and set Over with their and every of their Appurtenances unto him the said William Govane his Heirs and Assigns for Ever And the said Henry Morgan for and in Consideration of the Sum of five Shillings Sterling to him in Hand by the said William Govane Paid at or before the Sealing and Delivery of these Presents the Receit whereof he doth hereby acknowledge and thereof and therefrom and of and from every part and Parcel thereof doth hereby Release Acquit and Discharge the said William Govane his Heirs Executors Administrators and Assigns Hath Remised Released and for Ever quit Claimed and by these Presents Doth Remise Release and for Ever quit Claim unto him the said William Govane his Heirs and Assigns All those several Tracts of Land and Premisses with the Appurtenances in the said Recited Indenture mentioned called Friends Discovery lying and being in Baltimore County afs.d Containing by Estimation three hundred and Ninety Acres of Land one other Parcel of Land called Stones Delight Containing by Estimation One Hundred Acres and one other Parcel of Land called Locust Neck Containing by Estimation fifty Acres and also the therein mentioned Clause Condition Covenant or Proviso for the Redemption thereof and also all Equity of Redemption under or by means of the same and also all the Estate Right Title Dower Inheritance and Right and Title of (Dower) |
