75) Ex.d This Indenture made this 24.th Day of February in the Year of our Lord Christ One Thousand seven hundred and forty nine Between William Wintersell of Talbot County in the Province of Maryland of the one Part and Arthur Rigby of the same County and Province Planter of the other Part Witnesseth that the said William Wintersell for and in Consideration of the Sum of One Hundred Pounds Current Money of Maryland to him the said William Wintersell in hand Paid by the said Arthur Rigby before the Ensealing and Delivery of these Presents to the said Arthur Rigby whereof the said William Wintersell doth acknowledge the Receipt and himself and his Heirs fully Clearly and Absolutely Acquit Exonerate and Discharge the said Arthur Rigby his Heirs Executors Administrators or Assigns them & every of them for Ever and William Wintersell for himself & his Heirs hath Given Granted Bargained Sold Aliened and Enfeoffed and Confirmed and by these Presents Doth Give Grant Bargain Sell Alien Enfeoffe and Confirm unto the said Arthur Rigby and to his Heirs and Assigns for Ever two Tracts or Parcels of Land lying & being in Talbot County the one called Sharps Choice granted unto William Sharp the tenth day of January Sixteen hundred and Seventy nine for Three hundred Acres on the North side of Choptank River near the Head of the Western Branch of Tredhaven Creek and the other called Wintersell on the tenth day of July Anno Domini seventeen hundred and twenty five Resurveyed for Joshua Winters lying on the West side of a Creek called Island Creek Containing One Hundred and forty five Acres more or less to be held of the Manour of Baltimore together with all Appurtenances and Improvements thereof that then and in such Cases the said Arthur Rigby for himself and his Heirs & Assigns Doth Covenant Grant and Agree to and with the said William Wintersell his Heirs Executors & Administrators and every of them for Ever by these Presents to be fully Contented and Satisfyed therewith and the said William Wintersell Doth further Covenant and Grant unto the said Arthur Rigby his Heirs and Assigns that the said Arthur Rigby his Heirs & Assigns shall and may hold and Peaceably Enjoy all and Singular the Plantations Houses Orchards Pastures Fields Clear Grounds Woods and underwoods Trees and Timber in and upon the said Bargained Premisses or in and upon any part thereof and the Possession Reversion and Remainder and all the Estate Right Title Interest Property Claim or Demand of him the said William Wintersell and his Heirs of in or unto the said Bargained Premisses To have and to hold the said Two Tracts of Land the one called Sharp Chance Containing three hundred Acres and the other called Wintersell Containing One Hundred and forty five Acres as afs.d with all and Singular its Rights Members Jurisdictions and Appurtenances thereunto belonging or in any sort appertaining to him the said Arthur Rigby his Heirs and Assigns and to the only proper use and Behoofe of him the said Arthur Rigby his Heirs and Assigns for Ever and the said William Wintersell and his Heirs Do Covenant Grant and agree to and with the said Arthur Rigby ^and^ his Heirs and Assigns for Ever in manner and form following that is to say that |
