74) every Part and Parcel thereof is Clear of and from any all manner of Mortgages Judgments Statutes Merchant or of the Staple or other Incumbrance or Engagements by the Laws of Great Britain or of the Province of Maryland and he the said W.m Dallam doth further Covenant and Agree to and with him the said Godfrey Walters that he the said Godfrey Walters his Heirs and Assigns for Ever the said Three Hundred Acres of Land Part of Dallams self Preservation as herein before Described with all and Singular its Appurtenances shall and may from this time forward and at all times hereafter have hold and Quietly and Peaceably enjoy as well against him the said William Dallam and his Heirs or any other of from by or under him or them Claiming or to Claim as against all manner of Persons or Claims whatsoever Except the Chief Rents to the Lord Proprietor of the Province of Maryland to become due for the said Three Hundred Acres of Land from and after the twenty fifth Day of March next Ensuing the Date hereof and he the said William Dallam for himself and his Heirs Doth Covenant Grant and Agree to and with him the said Godfrey Walters that he the said William Dallam or his Heirs shall and will at any time within the Space & Term of Twenty Years do and Execute or suffer to be Done and Executed any other or further Deed or Deeds Conveyance or Assurance in the Law for the more sure and better making over and Confirming unto him the said Godfrey Walters his Heirs and Assigns for Ever the said Three Hundred Acres of Land part of Dallams self Preservation with its Appurtenances that he the said Godfrey Walters his Heirs or Assigns or his or their Council Learned in the Law shall Advise Devise or require In Witness whereof and the foregoing Premisses the said Parties to these Presents have Interchangeably set their Hands and Affixed their Seals the Day and Year first above written W.m Dallam Seal Sealed & delivered in Presence of Joseph Hall Char Carroll Jun.r At the foot of the aforegoing Deed was thus Written Viz.t Reced of Godfrey Walters the Sum of Two hundred Pounds Sterling being the Consideration herein before mentioned I say reced P me July 17.th 1750 W.m Dallam Test Joseph Hall Cha.r Carroll Jun.r July 17.th 1750 Then Came before Robert Gordon one of the Prov.l Justices William Dallam of Baltimore County Merchant and acknowledged the foregoing Deed 12 1/2 and the Lands & Premisses therein mentioned to be the Right and Estate of Godfrey Walters his Heirs and Assigns for Ever according to the Act in that Case made and Provided Robert Gordon Reced for the use of the Right Honble the Lord Baltimore twelve Shill.s Sterl being for the Alienation Fine of the within Three hundred Acres of Land this 24.th July 1750 Benj Tasker Recorded July 24.th 1750 |
