73) Ex.d This Indenture made this 17.th Day of July in the Year of our Lord God 1750 By and Between William Dallam of Baltimore County Merchant on the one Part and Godfrey Walters of Ann Arundell County Planter on the other Part Witnesseth that the said William Dallam for and in Consideration of the Sum of Two Hundred Pounds Sterling Money of Great Britain to him in hand Paid by him the said Godfrey Walters the Receit whereof he Doth hereby acknowledge and thereof and every part and Parcel thereof doth Acquit Exonerate and Discharge him the said Godfrey Walters his Heirs Executors and Administrators Hath Given Granted Bargained Sold Aliened and Enfeoffed and Confirmed and by these Presents Doth Absolutely and freely Give Grant Bargain Sell Alien Enfeoffe and Confirm unto him the said Godfrey Walters his Heirs and Assigns for Ever all that Three Hundred Acres of Land Situate and being in Baltimore County between Gunpowder and Bush River being part of a Tract of Land called Dallams self Preservation Granted unto him the said William Dallam by Patent bearing Date the seventeenth Day of December in the Year of our Lord God One Thousand Seven hundred forty and Seven Beginning for the said Three Hundred Acres at the Beginning Trees of the whole Survey and Running thence South South East Seventy Perches South One Hundred Sixty & eight Perches thence Bounding on and with a Creek called Elk Creek the three following Courses Viz.t East Sixteen Perches South Eighty three Degrees East Seventy six Perches North Eighty two Degrees East thirty Perches thence Bounding on and with the Northern Branch or Fork of said Creek the three following Courses North Eight Degrees West Sixty Perches North Sixty two Degrees East twenty Eight Perches North Sixteen Degrees East fifteen Perches thence North thirty Degrees East forty six Perches untill it Intersects the North line of the whole Survey thence North One Hundred fifty and three Perches unto the End of the said North line of the whole Survey thence still Bounding on and with the Lines of the whole Survey East fifty one Perches North twenty two Perches thence by a Streight line to the End of the South by East two Hundred and Sixteen Perches line of the whole Survey which by Platt appears to be South Eighty six Degrees West two Hundred and two Perches thence Bounding on the Lines of the whole Survey the two following Courses West by South Ninety three Perches South thirty Perches and then to the Beginning Trees Containing Three Hundred Acres of Land together with all the Dwelling Houses Out Houses Barnes Stables Tobacco Houses Fencing Orchards Woods Underwoods Ways Easments Pastures Rights Priviledges Advantages and Appurtenances in or upon the said Land being belonging and Appertaining or which of Right did or ought to belong or appertain to the same To have and to hold unto him the said Godfrey Walters his Heirs and Assigns for Ever the said Three Hundred Acres of Land Part of Dallams self Preservation with the Appurtenances as herein before mentioned and Described or intended to be mentioned or Described and the said William Dallam doth for himself his Heirs Executors and Administrators Covenant and agree to and with him the said Godfrey Walters his Heirs and Assigns that at the time of the Ensealing and Delivery of these Presents he the said William Dallam hath good Right full Power and Authority to give Grant Bargain Sell Alien Enfeoffe and Confirm the said Three Hundred Acres of Land with its Appurtenances unto him the said Godfrey Walters his Heirs and Assigns for Ever and the same and (every) |
