693 Untill one or more good and Perfect Recovery or Recoveries may be had against him the said Charles Hammond of the same Lands and Premisses and it is Covenanted Granted Concluded and agreed by and Between all the said Parties to these presents that it shall and may be Lawfull to and for the said Edward Dorsey before the last day of the next Provincial Court to Prosecute out of the High Court of Chancery of this Province one or more Writ or Writs of Entry Sur Disseizin en le post against the said Charles Hammond returnable to the next Provincial Court Whereby the said Edward Dorsey shall and may respectively demand against the said Charles Hammond all and Singular the aforementioned Premisses with the appurtenances by such name or names, Quantity, or Quantitys, Quality or Qualitys, Number or Content of Acres as shall be though fitt and requisite unto which said Writ or Writs the said Charles Ham^mond^ewood shall appear in proper person and shall vouch to Warrantie the said Charles Homewood who shall appear Gratis upon the voucher and shall Enter into Warranty and shall Vouch over to warranty the common vouchee ^and the common vouchee^ shall appear and Imparll and afterwards make default whereby one or more Recovery or Recoverys Judgment or Judgments may be had and given for the said Edward Dorsey for Recovery of the said Lands Tenements Hereditaments and Premisses aforesaid against the said Charles Hammond and for the said Charles hammond to recover over in Value against the said Charles Hom^ewood^mond and for the said Charles Homewood to recover over in value against the Common Vouchee according to the manner and form of Common Recoverys in such cases used And it is further Covenanted Granted Concluded Agreed and Declared by and between all and every of the said parties to these presents and the true intent and Meaning of the parties to these presents is that from and immediately after the said Common Recovery or recoverys shall be had prosecuted and suffered as aforesaid of the said Premisses the said Recovery or Recoverys shall be & enure, and shall be Construed Esteemed Adjudged and taken to be and Enure, and are hereby declared to have been intended to be and enure, that the said Edward Dorsey and all and every other person or persons which shall be seized of the Premisses or any other part thereof by force and ^or^ Virtue of the said Common Recovery or Recoveries shall stand and be seized thereof and of every part and parcell thereof with their and every of their appurtenances to the only use and behoof of the said Charles Homewood his heirs and Assigns and to no other use Intent or purpose Whatsoever In witness Whereof the parties to these presents have interchangeably set their hands and seals the day and year first above Written Sealed and Delivered TW C Homewood seal in the presence of Basil Dorsey Jun.r C Hammond seal Thomas Lane Weems E Dorsey 8 sides Recorded May the 25.th 1756 |
