688) This Indenture made the twentieth day of May in the year of our Lord Exam.d seventeen hundred and fifty six Between John Martain of Worcester County in the Province of Maryland Planter of the one part and John Brice of the City of Annapolis in the province afs.d Gent of the other part Witnesseth that the said John Martin for and in Consideration of the sum of seventy one pounds Eight shillings and Eight pence sterling money to him in hand paid by the said John Brice the Receipt Whereof he the said John Martin doth hereby Acknowledge hath given granted bargained sold Aliened Enfeoffed and Confirmed and by these presents for himself ^and^ his Heirs doth give grant bargain sell Alien Enfeoffe and Confirm unto him the said John Brice his Heirs and assigns all those two Tracts or parcels of Land lying in Worcester County on pocomoke River the one Called Snow Hill Containing five hundred Acres of Land more or less the other Called Carlaverock containing two hundred Acres of Land more or less togeather with the reversion and reversions remainder and remainders Rents Issues and profits of the said Two Tracts of Land and premises with their each and every of their Appurtenances and all the Estate Right title Interest property Claim and demand whatsoever of him the John Martin of in or to the same two Tracts of Land or of in or to any part or parcel of them To have and to hold all and singular the before mentioned two Tracts of Land and premisses with their and every of their appurtenances unto him the said John Brice his Heirs and assigns for ever to the only proper use and behoof of him the said John Brice his heirs and assigns and to and for no other use Intent or purpose whatsoever and the said John Martin for himself his Heirs Ex.r and Adm.r hereby Covenants and agrees to and with the said John Brice his Heir Heirs and assigns that he the said John Martin and his Heirs the aforesaid two Tracts of Land and Premisses with their each and every of their appurtenances unto him the said John Brice against all manner of persons whatsoever shall and will well and truly warrant and for ever defend by these presents provided always and it is the true intent and meaning of these presents that if the above named John Martin shall well and truly pay or cause to be paid unto the afs.d John Brice his heirs or assigns the full and just sum of seventy one pounds Eight shillings & Eight pence sterling money with legal Interest thereon at or upon the tenth day of May which shall be in the year of our Lord seventeen hundred and fifty Eight and also the Charge of drawing and Recording this Mortgage then this Indenture and every Article and Clause therein contained shall be Voyd and of no Effect any thing ^herein^ before contained to the Contrary notwithstanding and the aforesaid John Martin hereby further Covenants and agrees to and with the said |
